Chap. 949.—An ACT to amend section 1 of an act entitled an act to estab-
lish a ferry across the Rappahannock river at or near the town of Falmouth,
approved February 28, 1898.
Approved March 7, 1900.
1. Be it enacted by the general assembly of Virginia, That it shall
he the duty of the county court of Stafford county, when petitioned by
fiftv voters of said county, one-half of whom shall be freeholders, to
cause a vote of the voters of said county to he taken at the next general
election, upon the question of authorizing the supervisors of said county
to build a bridge across the Rappahannock river, at or near the town
of Falmouth, such vote to be taken and canvassed and returns made
in the manner prescribed bv section sixty-three, chapter sixtv-one, code
eizhteen hundred and seventv-three. If it shall appear that three-
fifths of the qualified voters of the county voting upon the question are
in favor of said building of a bridge, and that said three-fifths include
a majority of the votes cast by freeholders at such election, then the
decision of said majority shall be carried out as follows—namely:
Said bridge shall be managed and controlled until the first dav of May,
nineteen hundred.
Hereafter it shall be the duty of the county court of Stafford county,
at its April term, nineteen hundred, and at its April term every four
years thereafter, to appoint three residents of Stafford county as bridge
commissioners, one for the magisterial districts of Aquia and Rock-
Hill and one for the magisterial districts of Hartwood and Falmouth,
and one at large: provided, that not more than two of said bridge com-
missioners shall be of one political party, who shall serve for a term of
four years from the first day of May, next, after their appointment,
and until their successors are appointed and qualify. Each commis-
sioner, when appointed, shall qualify and give bond before the said
court, or the judge thereof in vacation, with good security, for the
faithful performance of the dutics of his office, in such penalty as the
court may prescribe. And the said commissioners shall, when author-
ized by said judge, be empowered to locate and build said bridge, con-
demn land for landing and roads necessary for said bridge, and shall
require collection of tolls from all partics non-residents of the counties,
districts, or corporations subscribing to said enterprise not to exceed
for each person two cents; and for each wheel, two cents; each horse,
two cents; each head of cattle, one cent; and for sheep and hogs,
one and one-half cents per head. The said toll to be applied to the
maintenance or operation of said bridge.
But the said commissioners, should the vote be determined in favor
of such bridge, shall have full power to buy or lease either or both of
the existing bridges at Fredericksburg and Falmouth, instead of build-
ing said bridge.
2. All acts or parts of acts inconsistent with this act are hereby
repealed.
3. This act shall be in force from its passage.
