Chap. 907.—An ACT incorporating the Buckingham tram-road company.
Approved March 6, 1900.
1. Be it enacted by the general assembly of Virginia, That James
L. Anderson, H. M. White, R. M. Anderson, W. R. Silvey, and William

Piele, and such other persons as they may associate with them, and the
successors, be, and they are hereby, constituted a body politic and co
porate, by the name of the Buckingham tram-road company; and sha
have all of the powers, rights, and franchises necessary or proper fc
the purpose of locating, constructing, equipping, maintaining, an
operating a tram-road or tram-roads in the county of Buckingham, sta!
of Virginia. Said tram-road or tram-roads shall be constructed in suc
manner and of such material as may best suit the purposes of th
said company, and they may own, not exceeding ten thousand acres ¢
land, and may own and operate saw mills, mines, may buy and se
lumber and manufacture the same, and carry on a gencral lumber an
mining business in all of its branches, and if necessary conduct a ger
eral merchandise business in connection with same.
2. Any three of the corporators heretofore named may organize th
company by electing a president and board of directors, and may elec
and appoint such other officers as may be necessary for the prope
management of said company’s affairs, and thereupon they shall hav
and exercise all of the general powers and functions of a corporatior
and be subject to all restrictions imposed by the laws of the state o
Virginia applicable to internal improvement companies, except so fa
as same may be changed or modified by this act.
3. The said company shall have authority in executing their work t
build the said tram-road or tram-roads in any part of Buckinghar
ccunty that the business of the said company may require. The agere
gate length of the said tram-road or tram-roads not to exceed sixt:
miles, with the right to change or modify the gauge or otherwise alte
the structure and operation of their said road or roads at any tim
as their means or interests may justify or require.
4. The capital stock of this company shall be ten thousand ($10,000
dollars, to be divided into shares of the par value of one hundred ($100
dollars each, to-be full paid and non-assessable, and said stock may b
all common or such part or parts preferred, as said company may, fron
time to time, determine. Each share of the stock shall be entitled t
one vote.
5. It shall be lawful for the said company to raise money in suc!
amounts as its business may require, by the issue of bonds, or deben
tures, or upon its own notes or other securities, and may acquire i
subscription to the capital stock of the said company, or by donations
money, lands, land or other damages, work, labor, material, property
bonds, or other means available for their purposes, and to receive
subscriptions from individuals, other companies, associations, or cor
porations. The said company may sell, lease, or otherwise dispose o:
any lands or properties acquired under this section.
6. It is the intention and purpose of this corporation not to act
13 “common carriers,” but to move from point to point such materia
and produce as they may themselves own and control. They shal
have the right, however, to transport material and merchandise fo1
xther parties at such rate or rates as may be agreed upon between them
Nothing in this clause shall be construed to compel this company tc
carry merchandise or any other commodity for the general public.
7. It shall be lawful for the said company to extend its tram-road
or tram-roads into either or both of the counties of Cumberland or
Appomattox upon a majority vote of the board of supervisors of either
county.
8. For the purpose of acquiring land for the right of way or the
right of ways, for such tram-road or tram-roads and for no other pur-
pose, land shall be condemned under the existing statute laws of Vir-
ginia applicable to the acquiring of land by railroads and other such
corporations for internal improvements.
9. It shall be lawful for the said company to operate said tram-road
or tram-roads by horse power or other power as may best suit its pur-
poses. Its general office shall be located at White Hall, Buckingham
county, Virginia, but it may hold meetings of the stockholders or
directors, at any point in the state of Virginia that may best suit its
purposes; thirty days’ notice of such meeting or meetings to be adver-
tised at least four times in some weekly newspaper published i in Buck-
ingham or Appomattox county, Virginia.
10. The construction of said tram-road or tram-roads shall commence
within twelve months from the passage of this act, and be completed
within five years.
11. The said tram-road company, by the acceptance of this charter,
hereby agrees to pay all taxes, dues, and demands due to the state of
Virginia that may be hereafter assessed against it in lawful money of
the United States, and not in coupons.
12. All acts or parts of acts in conflict with this act are hereby
repealed.
13. This act shall be in force from its passage.
