Chap. 890.—An ACT to amend and re-enact an act entitled an act to au-
thorize the Maysville magisterial district, and other magisterial districts
of Buckingham county, to vote a subscription towards the construction
and extension of the Buckingham branch of the Chesapeake and Ohio
railway to Buckingham courthouse, approved February 28, 1898, and to
authorize a subscription towards the construction of a railroad from some
point on said Buckingham branch in said district to or near Buckingham
courthouse, and to extensions of said proposed railroad.

1. Be it enacted by the general assembly of Virginia, That an act
entitled an act to authorize the Maysville magisterial district and other
‘magisterial districts of Buckingham county, to vote a subscription
towards the construction and extension of the Buckingham branch
of the Chesapeake and Ohio railway to Buckingham courthouse, ap-
proved February twenty-eighth, eighteen hundred and ninety-eight, be
amended and re-enacted so as to read as follows:
That the judge of the county court of Buckingham county be, and he
i3 hereby, authorized to submit to the qualified voters of Mavsville
magisterial district, of Buckingham county, who are freeholders in said
district, any proposition of subscription to the construction of a stand-
ard or narrow gauge railway, from such point on the line of the Buck-
ingham branch of the Chesapeake and Ohio railway, in said district,
as may be determined. upon by said judge, to or near Buckingham
courthouse, but said subscription not to exceed the sum of fifteen
thousand dollars ($15,000.00). Said railway to be constructed by any
corporation now or hereafter chartered and authorized to construct the
same.
2. And the said judge of the county court of Buckingham county is
authorized to order an election at such time as he may think proper,
to take the sense of said voters upon the said proposition of subscription ;
the said election to be held in the manner now prescribed by law as
regards subscriptions by counties to works of internal improvement.
But a majority of the registered voters of said magisterial district who
are freeholders of said district shall be sufficient to carry and adopt said
subscription.
And if the said proposed railway is constructed by the aid of the
subscription of said Maysville magisterial district, then the taxes
levied upon the said proposed extension, when constructed, for general
county purposes, shall inure to the benefit of said magisterial district
for the payment of the interest on the amount of said subscription,
and for providing a sinking fund as hereinafter provided.
And said magisterial district is hereby authorized, for the purpose
of paying any such subscription, to issue its bonds, bearing not ex-
ceeding five per centum interest, in such denominations-and payable at
such time or times as may be directed by said court; which bonds shall
be issued by the supervisor for said district, signed by him and counter-
signed by the clerk of said court as may be ordered and directed by said
court. And a sinking fund for the discharge of the principal of said
subscriptions shall be provided for in such manner as said court may
direct, the taxes levied upon said railway for general county purposes
after payment of the interest on said bonds, to be applied to that pur-
pose, as far as it may be sufficient; and after the said bonds are fully
paid, the said railway property shall be taxed as other railway property
is taxed, and for the same purposes. And the said Maysville magisterial
district, through the supervisor of the said district, upon the order of
said court, shall be authorized within said district, to levy on all such
property, persons and business or industries as are now allowed to be
taxed for county purposes, such taxes as may be necessary to pay such
of the interest and principal on said bonds as may not be paid from the
scurces above mentioned. :
3. Upon the petition of fifty or more property holders of any other
magisterial district in said county of Buckingham, the said judge shall,
in the same manner as herein provided, submit to the qualified voters
of said district or districts, a proposition in the manner above provided
of subscription to said proposed railroad, or any extension thereof,
not to exceed in any one of said districts the sum of two thousand
dollars; but any lesser amount may, in the discretion of said court,
be submitted to anv one or more of said districts, and the taxes levied
upon said proposed railway, or any such extension thereof, when con-
structed, for general county purposes, shall inure to the benefit of such
districts as may subscribe toward the construction of the same, in
proportion to the amount they may subscribe, to be used in the same
manner as is herein provided for the said Maysville district.
4, This act shall be in force from its passage.
