Chap. 888.—An ACT to permit A. A. McAllister, of the county of Alleghany,
to change the bed of Dunlap’s creek, near its mouth, through his own lands,
near the town of Covington, in said county.
Approved March 6, 1900.
Whereas A. A. McAllister is the owner in fee simple of lands on both
sides of Dunlap’s creek, near Covington, in the county of Alleghany,
from the mouth of said creck for a distance of two miles or more up
said creek; and
Whereas the waters of said creek, by reason of the abrupt meanderings
of the present stream of Dunlap’s creek as it flows through said lands,
in times of freshets have ploughed great channels through the tillable
land of said A. A. McAllister; and
Whereas by changing the bed of said stream at one or more points
through said land, so as to make the said stream run along the foot-
hills, such damage can be avoided; therefore,
1. Be it enacted by the general assembly of Virginia, That the
said A. A. McAllister be, and he is hereby, authorized and empowered,
at his own proper cost and charge, to change the bed of said creek
through his own lands, near the town of Covington, in said county
of Alleghany, at such point or points as he may desire, so that no
other landowner shall or may be injured or inconvenienced thereby.
2. That the title to the present bed of the said creck, when so
changed, shall be and beeoine the property of the said A. A. Mc-
Allister as fully and completely as if the said stream had never flowed
over or through the same, and the title to the said new bed, when
so changed, shall be and become the property of the state of Virginia
to the same extent. But to no greater extent than the present channel
or bed of said stream is now the property of said state of Virginia.
3. This act shall be in force from its passage.
