Chap. 863.—An ACT to provide for the issuing of bonds by Montgomery
county to macadamize the road from Christiansburg to Blacksburg.
Approved March 6, 1900.
1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of Montgomery county be, and they are, authorized
to issue bonds on such time and at such rate of interest as they can
contract for, not exceeding the legal rate, for such sum not exceeding
twenty-five thousand dollars, as may be necessary to make a good
macadamized road from Christiansburg to Blacksburg.
2. So soon as the road is macadamized the board may establish not
exceeding two toll gates between Christiansburg depot and Blacksburg
and fix a reasonable rate of tolls and provide for the collection thereof.
The general laws of the commonwealth in regard to the collection of
tolls on turnpikes, shall apply to said road and the tolls thereon. The
board of supervisors may, from time to time, alter the rates of toll.
3. The board is hereby invested with the power to employ all nec-
essary officers, agents, and laborers to have the road macadamized, or
to let it to contract on specifications, as it may deem best, or to have
a part of the work done in one way and part in the other.
4. The board shall provide for full reports of the expenses of the
work, and the persons to whom, and the purposes for which money is
paid, and for a proper inspection of the work as it progresses. It may
require bond and security from any person employed where it deems
it necessary. The bond to be conditioned for the faithful performance
of the duties the person is employed to perform, and for the proper
accounting for all money and property he may receive.
5. The tolls shall, under proper regulations of the board, be paid
by the toll gatherer to the county treasurer, who shall keep the same
separate and apart from the other funds which come into his hands, and
the same shall be paid out only for the purposes herein provided for.
6. The county treasurer shall not receive any commission on the
borrowed money, but shall receive commission on the tolls as though
they were a part of the county revenue.
7. If the tolls are insufficient to keep the road in repair and to pay
the interest on the bonds, and to provide a sinking fund of two per
centum a year on the bonds, the deficiency shall be included in the
annual county levy, and set apart for that purpose.
8. The board shall arrange to have the work begun within sixty days
after negotiating the bonds.
9. This act shall be in force from its passage.
