Chap. 829.—An ACT to create Ettrick sub-school district, in Matoaca school
district, of Chesterfleld county.
Approved March 6, 1900.
1. Be it enacted by the general assembly of Virginia, That that
portion of Matoaca school district of Chesterfield county embraced
within the following lines and boundaries—to wit: Beginning on the
north side of Appomattox river at the eastern line of the right of
way of the Richmond, Petersburg and Carolina railroad company; thence
along the said eastern line of said right of way to the southerly line
of the river road at the land of the Davies estate; thence along the
southerly line of said river road to the eastern line of the right of way
of that part of the line of the Atlantic coast line railroad company called
the “ Belt line; ” thence along said eastern line of said right of way to
Appomattox river; thence along the northern line of said river to the
point of beginning, be, and the same is hereby, created a sub-school
district by the name of Ettricks sub-school district.
2. That there shall be three school directors for said sub-district,
who shall be appointed by the county court of Chesterfield at its June
term in the year nineteen hundred, and at the June term in each year
thereafter; said directors to hold office for one year, commencing on the
first day of July following their appointment: provided, however, that
when any member or trustee of the Matoaca school district board shall
reside within said sub-district he shall, ex officio, be one of said directors
and chairman of the board, and said court shall only appoint the other
two directors. No person who does not possess a fair education shall
be appointed a director. All vacancies occurring in said board shall be
filled by the county court at any time. It shall be the duty of said
court to vacate the office of any director who shall fail to discharge his
duties according to law. Before entering upon the discharge of his
duty each director shall qualify in the manner required of school trus-
tees. Said directors shall constitute a board, and shall elect one of their
number chairman, except where one is a member or trustee of Matoaca
school district, he shall ex officio be the chairman, and another secre-
tary; and any two shall constitute a quorum. The secretary shall keep
a record of the proceedings of the board, and the same shall be signed
by the chairman and attested by the secretary. They may hold meet-
ings when called by the chairman or requested by any two directors.
3. The duties of said board of directors in said sub-district shall be in
general as follows, subject to be defined more particularly by the board
of education:
First. To explain and enforce the school laws, and observe the same.
Second. To employ teachers and make such contracts with them as
required by law and to dismiss them when delinquent, inefficient, or in
any wise unworthy of the position: provided, however, that no teacher
shall be dismissed without the approval of the county superintendent
of schools, who may be called upon by said board to sit with them
IN passing upon that matter.
_ Third. To suspend or dismiss pupils when the prosperity and effi-
ciency of the schools make it necessary.
Fourth. To decide what children wishing to enter the schools of the
sub-district are entitled by reason of poverty of their parents or guar-
1ans, to receive text-books free of charge, and to provide for supplying
them accordingly.
Fifth. To visit the schools and take care that they are conducted
according to law and with the utmost efficiency, and to prescribe regu-
ations and rules for conducting the same, subject to the approval of
he county superintendent, and not inconsistent with law or rules of
the board of education.
Sixth. To take care of, manage, and control the school propertv
within the sub-district, and provide school-houses, and repairs thereof,
school furniture and appliances, and other incidental things.
: eventh. To make report on any matter required by the county
uperintendent, and to make annual reports, as required by sub-division
1 of section fourteen hundred and sixty-six of the code of Virginia.
he county superintendent of schools and the Matoaca district
school board shall, upon the statement of the commissioner of the
revenue, herein provided for, and such other information as they may
have, apportion and set apart for the use of the said sub-district all
school funds which it would be entitled to if it were a separate district,
and shall provide said board of directors with a statement thereof.
5. The commissioner of the revenue shall annually, at the time of
making up his land and property books, make a list or statement, taken
from said books, showing the school taxes or levies within said sub-«is-
trict, delivering a copy thereof to each the chairman of said board of
directors, the county superintendent of schools, and the county treas-
urer. All funds to which said sub-district may be entitled shall be
expended on account of the schools within the same. For his services
the commissioner of the revenue shall receive reasonable compensation,
to be allowed by the said board of directors, payable out of the funds
of said sub-district.
6. All claims against said sub-district, including the pay of teachers,
shall be passed upon by said board of directors, and, if approved, certi-
fied by the chairman and secretary to the board of trustees of Matoaca
school district and the county superintendent of schools, who shal! issue
warrants upon the county treasurer in the same manner that warrants
are issued under the general school laws, except that each warrant
shall show on its face that it is issued on account of Ettricks sub-dis-
trict. Claims shall not be allowed by the said board of directors for
an aggregate amount greater than the revenue to which said sub-
district may be entitled, nor shall warrants be issued for a greater
amount in the aggregate than said revenue; and said board, in approv-
ing claims or in issuing warrants, shall make due allowance for the
delinquent lists likely to be charged against said sub-district.
?. The county treasurer shall, in addition to the accounts kept by
him of the Matoaca school district funds, keep a separate account show-
ing receipts and disbursements on account of said Ettricks sub-district.
8. When the clerk of the Matoaca school district board shall take
the census of the school population, he shall make a separate list of
the school population within said sub-district, and deliver a copy thereof
to the chairman of said board of directors, and the original file with
the county superintendent of schools, to be used by him in connection
with his duties under the fourth section of this act. For this service a
reasonable allowance shall be made bv said board of directors.
9. Nothing in this act shall be construed as divesting the Matoaca
school district of the title to the school property within said sub-dis-
trict, but it shall be under the control of the said board of directors
as herein set forth.
10. The directors provided for in this act shall receive no compensa-
tion for their services. They shall be subject to the provisions of
sections fourteen hundred and seventy-two, fourteen hundred and
seventy-three and fourteen hundred and seventy-four of the code of
Virginia.
11. The county superintendent of schools shall have the same au-
thority in said sub-district that he has or may have in other school
districts.
12. This act shall be in force from the first day of June, nineteen
hundred.
