Chap. 827.—An ACT to amend and re-enact section 22, chapter 95, acts of
assembly of 1876-’77, of an act approved February 17, 1877, entitled an act
to provide for working and keeping the public roads in order in Clarke
county. ,

1. Be it enacted by the general assembly of Virginia, That section
twenty-two of chapter ninety-five, acts of assembly of eighteen hun-
dred and seventy-six and seventy-seven, of an act approved February
seventeenth, eighteen hundred and seventy-seven, entitled an act to
provide for working and keeping the publie roads in order in Clarke
county, be amended and re-enacted so as to read as follows:
§ 22. Every petition for a new road, or to lay out, open, alter, or
change a public road must first be presented to the commissioner of
roads of the district in which the road is, who shall endorse thereon
his approval or disapproval of the same, and his reasons therefor; which
petition and commissioner's report sliall be laid before the ‘county
court, to be proceeded in as is now provided in the general road law
of the state. A plat of said road shall accompany said report, and said
plat and report, together with the report of the viewers, if said road be
opened or changed, shall be recorded in a book kept for that purpose
by the clerk of the board, and properly indexed, for which the said clerk
shall be paid at the same rates now paid: for recording similar papers.
All roads in Clarke county which have been used and worked as public
roads by the road authorities of said county are hereby declared to be,
in all respects and for all purposes provided by law, public roads of
said county, whether the condemnation proceedings and other records
of the opening of said roads and the dedication thereof to public use
can be found or not. Nothing in this act shall apply to cases now in
htigation as to rights of way.
2. This act shall be in force from its passage.
