Chap. 81.—An ACT to amend and re-enact an act entitled an act to provide
for the appointment of special prosecuting attorneys in proper cases,
approved March 3, 1898.
Approved January ll, 1900.
1. Be it enacted by the general assembly of Virginia, That an act
entitled an act to provide for the appointment of special prosecuting
attorneys in proper cases, approved March third, eighteen hundred and
ninety-eight, be amended and re-enacted so as to read as follows:
That during the absence or inability of the commonwealth’s attorney
of any county or corporation, from sickness or other cause, to discharge
the duties of his office, or, in any case where it would be improper for
him to act, the county or corporation court of such county or corpora-
tion, or the judge thereof in vacation, may appoint a special prosecu-
ting attorney to discharge the duties of such oftice during such absence
or inability, or while it is improper for the said commonwealth’s at-
torney to act; and such special attorney so appointed shall have all the
powers and privileges of the commonwealth’s attorney, and be entitled
to the same fees as such commonwealth’s attorney would be entitled to
in such cases.
2. This act shall be in force from its passage.
