Chap. 805.—An ACT to transfer to the county of Shenandoah the state’
interest in the Mount Jackson and Howard Lick turnpike company.

Whereas under authority of an act passed’ by the general assembl:
of Virginia on the ninth day of March, one thousand eight hundred an
sixty, entitled an act to provide for the construction of a turnpike roa
from Mount Jackson to Howard Lick, a turnpike road was constructe:
by the state of Virginia from Mount Jackson to Howard Lick; and
Whereas now, by reason of the partition of the commonwealth of Vir
ginia, about thirteen miles of said road remains within the present limit:
of Virginia, and this section lies altogether in the county of Shenan
doah; and
Whereas it now appears to the general assembly that the managemen
and control of such section of the road should be transferred to the
board of supervisors of Shenandoah county to the relief of the boarc
of public works of Virginia; therefore,
1. Be it enacted by the general assembly of Virginia, That the boarc
of public works be, and they are hereby, authorized and directed to trans.
fer all the rights, title, and interest of this state, in and to the Mount
Jackson and Howard Lick turnpike roads, or so much thereof as lie
in the county of Shenandoah, together with all bridges and other pro.
perty belonging or appertaining thereto, to the county of Shenandoah.
2. It shall be the duty of the board of supervisors of Shenandoal
county to take charge of so much of said road as lie within said countv
and cause the same to be put and kept in repair. It shall forthwith ap-
point such oflicers and agents as may be needed for the efficient opera-
tion of said road, and may remove the same from time to time as tc
said board may seem proper. It shall regulate and cause the toll to be
faithfully collected with the rates to be prescribed by said board, and
regularly applied to the maintenance and improvement of the road,
and if there be any surplus revenue it shall be paid into the treasury of
the state. It shall have the same privileges and rights, with regard to
said road as heretofore may have been held and exercised by the board
of public works.
3. This act shall be in force from its passage, but is subject to revo-
cation by an act of the legislature.
