Chap. 759.—An ACT confirming the action of the city council of Alexandria,
Virginia, authorizing the use of certain of its streets by the southern railway
company and other railroad companies for the tracks, switches, and turn-
outs of said companies, and confirming to certain firms, individuals, and
corporations rights with respect to the same, as herein particularly set forth.

Whereas the common council of Alexandria did, on March sixteenth,
eighteen hundred and forty-nine, authorize the Orange and Alexandria
railroad company (of which said southern railway company is the suc-
cessor) to construct and lay down a single track railway, with the neces-
sary turnouts, on Wilkes and Union streets in Alexandria, Virginia; and
Whereas the general assembly of Virginia, by an act passed March
twenty-seventh, eighteen hundred and fifty, did confirm the action of the
common council of Alexandria; and
Whereas the common council of Alexandria, in order to aid its mer-
chants and facilitate the receipt of and make easy the delivery of freight
to them, thus adding to the business interests of said city, has from time
to time granted permission to lay tracks, switches, and turnouts for
the purposes mentioned; and
Whereas it is the desire of the parties, firms, and corporations to
whom such permission has been granted to have the use of said tracks,
switches, and turnouts legalized by the general assembly of Virginia;
therefore,
1. Be it enacted by the general assembly of Virginia, That the
permission granted by the city council of Alexandria, on March twenty-
sixth, eighteen hundred and seventy-six, to construct the switch or side-
track connecting with the track of the Washington and Ohio railroad
for the use of W. A. Smoot and company, be, and the same is hereby,
confirmed.
2. That the said switch or side-track connected with the tracks of the
southern railway company (the successor of the Washington and Ohio
railroad), on Union street between Queen and Princess streets in the
city of Alexandria, Virginia, be, and it is hereby, legalized for the use
of W. A. Smoot and company, their successors or assigns, owning the
properties abutting on Union street, and it shall be lawful for the said
southern railway company and its successors, and they are hereby au-
thorized to use said side-track or switch in operating its locomotive
engines and cars in handling freight and conducting the business of said
railway company.
3. That the permission granted by the city council of Alexandria on
December seventeenth, eighteen hundred and eighty-six, and as amended
March eleventh, eighteen hundred and eighty-seven, and March twelfth,
eighteen hundred and ninety-six, granting permission to the Virginia
midland railway company to construct, maintain, and operate with
its locomotive engines and cars the switches and sidings on the east
side of Union street from King to Wolfe streets, and from Fayette alley
on Union street to Oronoco street, in Alexandria, Virginia, be, and the
same is hereby, confirmed.
4. That said tracks, switches, and side-tracks are hereby legalized for
the use of the said southern railway company (the successor of the
Virginia midland railway company) and its successors, and it shall be
lawful, and the said southern railway company and its successors are
hereby authorized to use said switches, tracks, and side-tracks in operat-
ing the same with its locomotive engines and cars, in handling freight
and conducting the business of said railway company.
5. That the permission granted by the city council of Alexandria to
the Alexandria fertilizer and chemical company on March twenty-fifth,
eighteen hundred and ninety, to lay railroad tracks across Union street,
running into its property abutting on said street, in the city of Alex-
andria, Virginia, for the use of the said Alexandria fertilizer and chemical
company, be, and the same is hereby, confirmed.
6. That the said tracks laid across Union street and running into the
property of the said Alexandria fertilizer and chemical company, abutting
on Union street, in the city of Alexandria, Virginia, be, and they are
hereby, legalized for the use of the said Alexandria fertilizer and chem-
ical company, their successors or assigns, and it shall be lawful for
the said southern railway company and its successors, and they are
hereby authorized, to use said tracks, in operating its locomotive engines
and cars, in handling freight and conducting the business of said rail-
way company.
?. That the permission granted by the city council of Alexandria,
Virginia, April twenty-seventh, eighteen hundred and ninety, to John
R. Zimmerman, to lay railroad tracks on Union street between Cameron
and Queen streets in Alexandria, Virginia, running into his property
abutting on said street, for the use of the said John R. Zimmerman, be,
and the same is hereby, confirmed.
8. That the said tracks on Union between Cameron and Queen streets,
Alexandria, Virginia, running into the property of the said John R.
Zimmerman, be, and the same are hereby legalized for the use of the
said John R. Zimmerman, his successors or assigns, and it shall be lawful
for the said southern railway company and its successors, and they are
hereby authorized to use said tracks in operating its locomotive engines
and cars upon the same, in handling freight and conducting the business
of said railway company.
9. That the permission granted by the city council of Alexandria,
Virginia, June twenty-eighth, eighteen hundred and ninety-two, to
Herbert Bryant, to construct a railroad track at the foot of Duke street
in Alexandria, Virginia, connecting with the tracks of the southern rail-
way company, and abutting on his property on Union street, for the use
of the said Herbert Bryant, be, and the same is hereby, confirmed.
10. That the said track be, and the same is hereby, legalized for the
use of the said Herbert Bryant, and it shall be lawful for the southern
railway company and its successors, and they are hereby authorized to
use said track in operating its locomotive engines and cars upon the
same, in handling freight and conducting the business of said railway
company.
11. That the permission granted by the city council of Alexandria,
Virginia, June thirtieth, eighteen hundred and ninety-three, granting
permission to the Richmond and Danville railroad company to lay rail-
road tracks, and construct and operate the same on Jefferson, Green,
Church, and Lee strects, in Alexandria, Virginia, connecting with the
tracks of said company on Union street in said city, be, and the same is
hereby, confirmed.
12. That the said tracks are hereby leealized for the use of the
southern railway company (the successor of the Richmond and Danville
railroad company) and its successors, and it shall be lawful and the said
southern railway company is authorized to use the said tracks, in operat-
ing its locomotive engines and cars, in handling freight and conducting
the business of the said railway company.
13. That the permission granted by the city council of Alexandria,
Virginia, February eleventh, eighteen hundred and ninety-six, to the
Robert Portner brewing company, to lay and construct tracks on Wythe
street in Alexandria, Virginia, to connect with the tracks of the southern
railway company on Lee street in said city, be, and the same is hereby,
confirmed.
14. That the said tracks on Wythe street connecting with the tracks
of the southern railway company on Lee street, in the city of Alexandria,
Virginia, be, and they are hereby, legalized for the use of the Robert
Portner brewing company, their successors or assigns, owning properties
abutting on Wythe street, and it shall be lawful for the said southern
railway company and its successors, and they are hereby authorized to
use said tracks in operating its locomotive engines and cars, in handling
freight and the conduct of the business of the said railway company.
15. That the permission granted by the city council of Alexandria,
Virginia, on June twenty-second, eighteen hundred and ninety-seven,
to DeWilton Aitcheson to construct a side-track or switch on Union
street in Alexandria, Virginia, and running into his property abutting
thereon, and connecting with the tracks of the southern railway company
on said Union street, be. and the same is herehv, confirmed.
16. That the side track or switch connecting with the tracks of the
southern railway company and running into the praperty of the said
DeWilton Aitcheson, be, and it is hereby, legalized for the use of the
said DeWilton Aitcheson, his successors or assigns, and it shall be lawful
for the said southern railway company and its successors, and thev are
hereby authorized to use said side track or switch, in operating its loco-
motive engines and cars, in handling freight and conducting the business
of the said railway company.
17. That the permission granted by the city council of Alexandria,
Virginia, on March twenty-second, eighteen hundred and ninety-six to
the southern railway company to lay a railroad track, with necessary
turnouts, on Lee street north to Wythe street, and thence west on Wythe
street to Saint Asaph street, in the city of Alexandria, Virginia, be,
and the same is herehy, confirmed.
18. That the said track is hereby legalized for the use of the said south-
ern railway company and its successors, and it shall be lawful and the said
southern railway company and its successors are hereby authorized to
use said track in operating the same with its locomotive engines and
cars, in handling freight and conducting the business of said railway
company.
19. That the permission granted bv the city council of Alexandria,
Virginia, January thirtieth, nineteen hundred, to the southern railway
company to construct a standard gauge railroad track on the west side
of Henry street, from the north side of Duke street to the south side
of Wolfe street, in Alexandria, Virginia, and connecting with the tracks
of the said southern railw ay company at Wolfe street and to operate
the same with its locomotive engines and passenger cars, be, and the
same is hereby, confirmed.
20. That the said track is hereby legalized for the use of the said
southern railway company and its successors, and it shall be lawful and
the said southern railway company and its successors are hereby au-
thorized to use said track in operating the same with its locomotive
engines and passenger cars in conducting the business of the said rail-
way company.
21. That the permission granted bv the city council of Alexandria,
Virginia, on the thirteenth day of February, nineteen hundred, to the
Alexandria fertilizer and chemical company to construct a side-track
or switch on Union street, between Queen and Princess streets, in
Alexandria, Virginia, connecting with the tracks of the southern rail-
way company, and running into the property of the said Alexandria
fertilizer and chemical company, be, and the same is hereby, confirmed.
22. That the said switch or side-track on Union street between
Princess and Queen streets, connecting with the tracks of the southern
railway company and running into the property of the said Alex-
andria fertilizer and chemical company, their successors or assigns, and
it shall be lawful for the said southern railway company and its succes-
sors, and thev are herebv authorized to use said switch or side-track
in operating the same with its locomotive engines and cars, in the han-
dling of freight and conducting the business of the said railway company
23. But it is expressly understood that nothing in this act shall in
any wise affect the rights of property owners along the line of said
tracks, switches, and turnouts.
24. This act shall be in force from its passage.
