Chap. 756.—An ACT to approve and confirm the acts and resolutions of the
council of the city of Portsmouth in reference to the issue of bonds under
an act approved January 25, 1898, and to ratify the said bonds.
Approved March 6, 1900.
Whereas by an act of the general assembly of Virginia, entitled “an
act to authorize the council of the city of Portsmouth to issue redemp-
tion bonds,” approved January twenty-fifth, eighteen hundred and
ninety-eight, the council of the city of Portsmouth, in order to redeem
the unpaid balance of paving bonds, issued by said city under an act of
the general assembly, approved May the twentieth, eighteen hundred
and eighty-seven, and to redeem the unpaid balance of the bonds issued
by said city under an act of the gencral assembly, approved January
twenty-first, eighteen hundred and sixty-seven, as they mature, was
authorized to issue bonds not to exceed two hundred thousand dollars.
The said bonds to be signed by the president of the council and the
city treasurer, and attested by the city clerk; and
Whereas the council of said city under the above mentioned act of
January twenty-fifth, eighteen hundred and ninety-eight, issued bonds
to the extent of one hundred and forty thousand dollars, dated January
first, nineteen hundred, for the purpose of redeeming the unpaid balance
of the bonds issued under the act of January twenty-first, eighteen hun-
dred and sixty-seven, which said bonds were signed by the president
of the council and the city treasurer, and attested by L. P. Slater, acting
clerk; and
Whereas some question has arisen touching the right of the said L. P.
Slater, acting clerk, to attest the said bonds, and other questions have
arisen respecting the issue of the bonds under the act of January twenty-
first, eighteen hundred and sixty-seven, for which the bonds of January
first, nineteen hundred, were issued to redeem, which question can-
not be now determined on account of the imperfect condition of the then
proceedings of the council; and
Whereas the said bonds issued under the act of January twenty-first,
eighteen hundred and sixty-seven, were issued for the benefit of the said
city, and the said city received the benefit arising therefrom, and has
always recognized their validity by the payment of all interest due
thereon; therefore,
1. Be it enacted by the general assembly of Virginia, That the
acts and resolutions of the council of the city of Portsmouth in respect
to the issue of the one hundred and forty thousand dollars of bonds,
dated January first, nineteen hundred, under the act of January twenty-
fifth, eighteen hundred and ninety-eight, to redeem bonds issued under
the act of January twenty-first, eighteen hundred and sixty-seven, to-
gether with the attestation by L. P. Slater, acting clerk, be approved,
ratified, and confirmed, and the said bonds in all respects, be hereby
made regular and valid.
2. This act shall take effect from its passage.
