Chap. 673.—An ACT to incorporate old dominion college at the town of
Honaker, in Russell county.
Approved March 2, 1900.
1. Be it enacted by the gencral assembly of Virginia, That J. M.
Kendrick, M. C. Clark, Z. N. Slaughter, Alson Hulton, and B. H. Jones,
and their successors in office, be, and they are hereby, constituted trus-
tees of old dominion college, and made a body politic and corporate,
under the name and style of old dominion college, and by that name have
perpetual succession, and a common seal, and may sue and be sued,
plead and be impleaded, in any court of law or equity; and the said
trustees of old dominion college shall be capable in law to receive, hold,
and dispose of real and personal property, in order to carry out the
purposes of their incorporation: provided, the amount of real and _ per-
sonal estate shall not exceed forty thousand dollars.
2. The said old dominion college shall be under the contro] and man-
agement of the said trustees and their successors in office, who shall
appoint a treasurer and all necessary officers and professors, and, from
time to time, make such by-laws, rules, and regulations for the govern-
ment of said college, as to them shall seem fit, not inconsistent with
the laws of this state or of the United States.
3. The board of trustees, two-thirds concurring, shall have power to
remove any trustee for good cause, and by an entry on their minutes,
to declare his seat vacant.
4. A majority of the board of trustees shall constitute a board for the
transaction of ordinary business, and any vacancies in said board of
trustees, occasioned by death, resignation, or otherwise, shall be filled by
said board or by the survivors thereof.
5. The treasurer shall receive all moneys accruing to the college and
property delivered to his care, if so directed by the board and shall pay or
deliver the same to the order of the trustees. Before entering upon the
discharge of his duties he shall give bond, with such security and in
such penalty as the board may direct, made payable to the trustees for
the time being, and their successors in office, conditioned for the faithful
performance of the duties of his office in all such rules and regulations
as the board may adopt.
6. The board of trustees shall have power, either by themselves or
their agents, to take and receive subscriptions for said college, and mav
enforce the collection of the same (if not paid when due) by warrant
before a justice of the peace or by suit in any court having jurisdiction
of the subject matter.

7. The board of trustees, in connection with the president and pro-
fessors of said college, shall have power to grant certificates of distinction
and confer diplomas and literary titles, solely upon merit, and as they
may think best calculated to promote the cause of education.
8. This act shall be in force from its passage.
