Chap. 663.—An ACT to refund to the American cement company excess of
tax for recordation of deed.

Whereas the American cement company bv its deed bearing date
November ninth, eighteen hundred and ninety-nine, and now recorded
in the clerk’s offices of the counties of Nansemond and Isle of Wight,
did convey in trust to the Girard trust company of the city of Phila-
delphia, certain real estate and interests in real estate, in said deed
mentioned, to secure the payment of the sum of one million dollars;

Whereas with the exception of real estate and interests in real estate
in the counties of Nansemond and Isle of Wight, of the value of forty-
six thousand dollars, the real estate and interests in real estate conveyed
by the said deed, is beyond the limits of the state of Virginia, to wit,
in the states of Pennsylvania and New York; and
Whereas the clerk of the county court of the county of Nansemond,
in which county in this state, the said deed was first recorded, demanded
and received of the said American cement company, the sum of one
thousand dollars, as and for the tax imposed by the state of Virginia
upon the recordation of the said deed; and
Whereas it is the policy of this state to graduate and apportion the
tax for the recordation of deed according to the value of the property
conveved, or the amount loaned on the faith and credit of the said
property; and
Whereas upon such basis the tax for recording the same in this state
would not equitably exceed the sum of fortv six dollars; therefore,
1. Be it enacted by the general assembly of Virginia, That the
auditor of public accounts of Virginia be, and is hereby, directed to
refund and repay to the American cement company the sum of nine
hundred and four dollars, that being the excess of the amount which
equitably should have been paid as and for the state tax for the recor-
dation of the said deed.
2. This act shall be in force from its passage.
