Chap. 60.—An ACT to amend and re-enact sections 94 and 97 of an act
entitled an act to incorporate the city of Newport News, in the county
of Warwick, and to provide a charter therefor, approved January 16, 1896;
and creating the office of city attorney and authorizing the common
council to fill said office.

1. Be it enacted by the general assembly of Virginia, That sections
ninety-four and ninety-seven of an act entitled an act to incorporate the
city of Newport News, in the county of Warwick, and to provide a char-
ter therefor, approved January sixteenth, eighteen hundred and ninety-
six, be amended and re-enacted so as to read as follows:
§ 94. City attorney—There shall be one city attorney, who shall
prepare all bonds, obligations, contracts, leases, covenants, assurances,
and other documents which may be required of him by any ordinance
or order of the council or the general laws of the city. He shall com-
mence and prosecute all and every suit or suits, action or actions brought
by the city for or on account of the estate, rights, trusts, privileges,
claims, or demands of the same, and defend all actions or suits brought
against the city or any official thereof before any court of this common-
wealth, and shall do all and every professional act incident to the office
which may be required of him by the council, any committee thereof,
or the mayor, and all matters of law to which the city may be a party,
or in anywise interested shall be under his supervision, direction and con-
trol, subject to the direction of the council.
§ 97. The common council shall, at its next regular meeting after the
passage of this act, elect a city attorney, who shall hold office until the
first day of August, nineteen hundred, and until his successor be elected
and qualified, and in July, nineteen hundred, at the same time when
other city officers are elected, and bi-ennially thereafter, they shall
elect a city attorney, who shall hold office for a term of two years from
the first day of August succeeding his election and until his successor
be elected and qualified, unless sooner removed, and he shall receive for
his services such salary as shall be allowed by the council not exceeding
twelve hundred dollars per annum.
2. All acts or parts of acts in conflict with this act shall be, and they
are hereby, repealed.
3. This act shall be in force from its passage.
