Chap. 434.—An ACT to change the name of the Elizabeth night ferry company
to the Elizabeth river ferry company, and to amend and re-enact sections
1, 2, and 3 of an act entitled an act to incorporate the Elizabeth night ferry
company, approved January 15, 1896.

1. Be it enacted by the general assembly of Virginia, That sections
one, two, and three of an act to incorporate the Elizabeth night ferry
company, approved January fifteenth, eighteen hundred and ninety-six,
be amended and re-enacted so as to read as follows:
§ 1. Be it enacted by the general assembly of Virginia, That Charles
T. Bland, Joseph T. Duke, R. E. B. Stewart, M. L. Newbill, C. A. Baker,
L. T. Gunn, and R. L. Savage, their associates, successors, and assigns,
be, and they are hereby, incorporated into a body politic and corporate,
by the name of the Elizabeth river ferry company, for the purpose and
with the power of owning, equipping, leasing, chartering, and running
one or more yachts or boats propelled by naptha, gasoline, electricity, or
steam for the transportation of passengers and freight on the Elizabeth
river to and from Pinner’s Point and West Norfolk, in the county of
Norfolk, to Norfolk or Lambert’s Point, or to both or either, or to
or from any other point or points on either side of the Elizabeth river
or other navigable waters in the state of Virginia: provided, no ferry
be established, maintained, or operated between the city of Norfolk
and the city of Portsmouth, or the city of Portsmouth and the town of
Berkley, or the town of Berkley and the city of Norfolk, as the same
are now constituted, or from West Norfolk to Port Norfolk, within half
a mile of the bridge of the West Norfolk and Port Norfolk drawbridge
company, without the consent of said company.
§ 2. The capital stock of said company shall not be less than five
hundred dollars ($500.00), nor more than ten thousand dollars
($10,000.00), divided into shares of fifty dollars ($50.00) each. The
above named corporators, or any three of them, are hereby created a
commission, and authorized, either in person or by agent, to open books
and receive subscriptions to the capital stock of said Elizabeth river
ferry company. The capital stock may be increased from time to time
until the maximum sum named in this act is reached.
§ 3. Said company may acquire, by purchase or otherwise, and hold
real estate not to exceed ten (10) acres at each landing place, and
may mortgage and encumber, by deed of trust or otherwise, and dis-
pose of its real estate, wharves, docks, boats, and any other property,
privileges and franchises, and may lease to any other company or indi-
vidual or individuals any rights, privileges, or franchises which may
be granted herein, and may issue bonds to be secured upon its real
estate, and any other property and effects to secure any indebtedness
which it may lawfully contract under the laws of this commonwealth.
2. This act shall be in force from its passage.
