Chap. 413.—An ACT to provide payment out of the public treasury to Fau
quier county of the amount of criminal expenses erroneously paid by sai
county.

Whereas Fauquier county, through an erroneous construction of th
laws relating to the payment of jurors in criminal cases, for man
years past has been charged with and has paid out of her treasury |
large aggregate of money which should have been charged to and pai:
by the state of Virginia, which amount for the ten years next precedin
the first of January, eighteen hundred and ninety-eight, amounted t
the sum of two thousand seven hundred and seventy-three dollars an
sixty-six cents, without interest; and
Whereas upon application to the auditor of public accounts to have
said amount refunded to said county said auditor, although satistied
that said amount should have been paid by the state and ought to be
refunded to said county, acting under the advice of the attorney-gen-
eral, who doubted the propriety, under the law as it stood, of advising
its payment, declined to pay the same; and
Whereas the auditor of public accounts, the attorney-general of
Virginia, and the judge of the circuit court of the city of Richmond
have examined all the facts relative to the said claim, and are of opinion
that it is equitable and just, and should be refunded to said county by
the commonwealth of Virginia; therefore,
1. Be it enacted by the general assembly of Virginia, That the
auditor of public accounts be, and he is hereby, authorized and directed
to draw his warrant, payable out of any funds in the treasury not other-
wise appropriated, for the sum of twenty-seven hundred and seventy-
three dollars and sixty-six cents, payable to the board of supervisors of
Fauquier county, Virginia.
2. This act shall be in force from its passage.
