Chap. 39.—An ACT for the relief of P. D. Divers, treasurer of the county of
Franklin, directing and empowering the auditor of public accounts to issue
in his behalf a duplicate of a lost warrant.
Approved January 11, 1900.
Whereas, on April sixth, eighteen hundred and ninety-nine, there was
issued by the auditor of public accounts of Virginia a warrant, directed
to the treasurer of the said state, directing him to pay to P. D. Divers,
treasurer of the county of Franklin, six hundred and twenty-one dollars
and eighty-three cents. And whereas on the back of this warrant the
said treasurer of Virginia gave his check upon the first national bank
of Richmond, in favor of the said Divers, treasurer, &c., for the above
amount, dated on the date above; and
Whereas the said Divers having received this check, deposited the
same with the Exchange banking company of Rocky Mount, Virginia,
for collection; and
Whereas, in the course of transmission through the mails, this check
was lost; and
Whereas a statement from the treasurer of Virginia shows that this
check remains outstanding upon the books of his office, not having been
paid at the bank; and
Whereas, under the general law of eighteen hundred and eighty-nine,
ninety, the auditor cannot issue a duplicate warrant in this instance,
the amount involved being too great; and
Whereas it is proper that a duplicate warrant should issue to the said
Divers upon the execution of a proper refunding bond; now, therefore,
1. Be it enacted by the general assembly of Virginia, That the audi-
tor of public accounts be, and he hereby is, directed and empowered,
upon the execution by the said P. D. Divers, treasurer of the county of
Franklin aforesaid, of an indemnifying bond in the penalty of one thou-
sand two hundred dollars payable to the commonwealth of Virginia, with
security to be approved by the said auditor, and properly conditioned,
to issue in behalf of the said P. D. Divers a warrant for the amount
of the lost warrant, the same to be in all respects a duplicate of
the said lost warrant as described above, and as appears from the offices
of the auditor of public accounts, and treasurer of Virginia, respectively.
2. This act shall be in force from its passage.
