Chap. 369.—An ACT to amend and re-enact sections 2 and 15, and to repeal
section 11 of an act entitled an act to create Fairmount district, in Fairfield
magisterial district, in the county of Henrico, etc., approved January 15, 1900.

1. Be it enacted by the general assembly of Virginia, That sections
wo and fifteen of an act entitled an act to create Fairmount district, ir
‘airfield magisterial district, in the county of Henrico, and so forth
pproved fifteenth day of January, nineteen hundred, be amended anc
e-enacted so as to read as follows:
§ 2. That there shall be, and is hereby, established a board of im.
rovement commissioners for said Fairmount district, to consist of five
nembers, whose duty it shall be to determine what improvements of :
ublic nature shall be made in said district, and ascertain and assess :
ax upon the owners of real estate in said district to pay for said im
rovements: provided, however, that in no event shall such tax in an
me year exceed one-half of one per centum of the assessed value of th
eal estate therein as ascertained by the assessment thereof for the pur
ose of taxation by the state.
That it shall be the duty of the board of supervisors of the county o
Tenrico, Virginia, at the time of its annual settlement with the treas
irer of the said county to place with the said treasurer to the credit o
‘airmount district, an amount equal to one-half of the county levy upo
he real estate located within said district: provided, that the said dis
rict shall, at its own expense, keep its streets and roads in order: an
yrovided further, that the real estate of said district shall be exemp
‘rom the payment of any special road tax which shall hereafter be levie
yy said county.
§ 15. The said board of improvement commissioners shall be for th
irst term of office Johnson P. Newsberry, T. J. Teagle, S. A. Allez
J. L. Mitchell, and T. H. Morris. They shall hold office until the fir:
Jay of January, nineteen hundred and one, or until their successo.
shall have qualified. After thirty-first of December, nineteen hundre
the term of office shall be for two years, commencing first day of Jar
uary of each year. The members of the said board are to be electe
bv the qualified voters residing within the limits of this district on t}
first Tuesday in December in nineteen hundred, and biennially thereaft
on the first Tuesday in December.
2. Section eleven of said act be, and the same is hereby, repealed.
3. This act shall be in force from its passace.
