Chap. 365.—An ACT to amend and re-enact chapter 847, acts 1895 and 1896,
amending chapter 192, acts 1895 and 1896, entitled an act for the protection
of game in Roanoke county.

1. Be it enacted by the general assembly of Virginia, That chapter
eight hundred and forty-seven, acts of eighteen hundred and ninety-five
and eighteen hundred and ninety-six, amending chapter one hundred
and ninety-two, acts eighteen hundred and ninety-two and eighteen
hundred and ninety-four, entitled an act for the protection of certain
game in the county of Roanoke, approved March fifth, eighteen hundred
and ninety-six, so as to read as follows:
81. Be it enacted by the general assembly of Virginia, That it shall
be unlawful for any person to kill or capture in any way, or offer for
sale in Roanoke county, any wild turkey or ruffled grouse (or pheasants),
between the first day of February and the first day of November of
each year, or at any time in said county to take or destroy the eggs
of wild turkey or ruffled grouse (or pheasants), or to catch them with
net or trap.
§ 2. If any person violate any of the provisions of the preceding sec-
tion he shall be deemed guilty of a misdemeanor, and upon conviction
thereof, shall be fined ten dollars for each offense, and imprisoned in
the county jail until the fine be paid, but not exceeding thirty days.
In any prosecution of a person for the violation of any of the provisions
of the preceding section, proof of the possession by such person of any
such wild turkey, ruffled grouse (or pheasant), or eggs of same, shall be
prima facie evidence of guilt.
§ 3. All acts and parts of acts in conflict with this act are hereby
repealed. |
§ 4. This act shall be in force from its passage.
