Chap. 325.—An ACT to amend and re-enact sections 3752 and 3753 of the code
of Virginia in relation to how officers suffering prisoners to escape shall
be punished.

a. Be it enacted by the general assembly of Virginia, That sections
hree thousand seven hundred and fifty-two and three thousand seven
1undred and fifty-three of the code of Virginia, be amended and re-
nacted so as to read as follows:
§ 3752. Officer voluntarily suffering prisoner convicted of, or charged
vith felony, to escape; how punished.—If any sheriff, jailor, or other
fficer, or any guard, or other person summoned or employed by any
uch sheriff, jailor, or other officer, voluntarily suffer a prisoner con-
icted of or charged with felony, to escape from his custody, he shall
ye confined in the penitentiary not less than two nor more than ten
ears.
€& 3753. Or negligently suffering such prisoner or a prisoner not 80
onvicted or charged to escape, or wilfully refusing to receive a prisoner;
iow punished.—If any sheriff, jailor or other officer, or any guard or
ther person summoned or employed by such sheriff, jailor, or other
flicer, negligently suffer a prisoner convicted of or charged with felony,
r voluntarily or negligently suffer a prisoner convicted of, or charged
rith an offense not a felony, to escape from his custody, or wilfully re-
use to receive into his custody a person lawfully committed thereto,
e shall be confined in jail not exceeding six months, or be fined not less
han fifty nor more than five hundred dollars.
2. This act shall be in force from its passage.
