Chap. 305.—An ACT to amend and re-enact section 3838 of the code of Vir
ginia, as amended by an act approved March 5, 1890, in relation to attorney:
fees.

1. Be it enacted by the general assembly of Virginia, That sectio
three thousand eight hundred and thirty-eight of the code of Virgini
as amended by an act of the general assembly of Virginia approve
March fifth, eighteen hundred and ninety, in relation to attorney’s fe
be amended and re-enacted so as to read as follows:
§ 3838. Attorney’s fee; officers not allowed fees out of the treasur
in such cases.—In every case of conviction for an offense under an
preceding section of this chapter, or under chapter twenty-five of th
code of Virginia, an attorney’s fee of ten dollars shall be taxed in th
costs and paid by the defendant, and no attorney or officer shall b
entitled to the payment of any fees out of the treasury for services ren-
dered in a prosecution for such offense.
2. All acts and parts of acts in conflict with this act are hereby re-
pealed.
3. This act shall be in force from its passage.
