Chap. 268.—An ACT to ratify and confirm an agreement entered into on June
20, 1899, between the young men’s Christian association of the Virginia
polytechnic institute and the board of visitors of the Virginia agricultural
and mechanical college and polytechnic institute, as to the use of a building
being erected on the grounds of the said institute.

Whereas on the twentieth of June, eighteen hundred and ninety-nine,
an agreement was entered into between the young men’s Christian
association of the Virginia polytechnic institute and the board of visi-
tors of said institute, which is as follows:
“Memorandum of agreement entered into between the young men’s
Christian association of the Virginia polytechnic institute, a corporation
of the first part, and the board of visitors of the Virginia agricultural
and mechanical college and polytechnic institute of the second part—
witnesseth:
“Whereas it is proposed to erect on the grounds of the party of the
second part, at a site to be selected and according to plans and specifi-
cations agreed upon between the parties, a building to be used by the
young men’s Christian association for their purposes; and it being the
desire and intention of the parties hereto that when the said building is
completed and ready for occupation that the same shall be under the
rules and regulations prescribed by the governing authority of the
young men’s Christian association of the United States, so far as the
same do not come in conflict or interfere with the rules and regulations
prescribed for the government of the students at said institute.
“Tt it covenanted and agreed by and between the parties hereto that
the said building, when completed, shall be used for the purposes of the
young men’s Christian association under such rules and regulations as
may be agreed upon, reserving to the parties of the second part at all
times the right to prescribe such rules and regulations as to when, how,
and in what manner said building shall be used for religious, social. or
literary purposes, and the authority hereby given the parties of the
second part may be delegated to the president of the institution or to the
faculty, and their action, when the power is so delegated, shall be as
binding as if the act were done by the parties of the second part.
“Tt is the intention of the parties hereto that so long as the building
is used for the usual purposes of the young men’s Christian association
that they shall have all the rights and privileges consistent with the
duties required of the students at such institution, so that the studies.
discipline, and good order of the institution shall not be affected
thereby.” ,
And by a resolution of the board of directors passed on the twentieth
of June, eighteen hundred and ninety-nine, the president of the institute
was authorized to execute the agreement on the part of said board: and
Whereas a doubt has arisen as to the authority of the board of visitors
of said institute to make a binding agreement, such as is above set
forth; therefore,
1. Be it enacted by the general assembly of Virginia, That the said
agreement of the twentieth of June, eighteen hundred and ninety-nine,

itified and confirmed, and that the same shall remain in full force

2. This act shall be in force from its passage.
