Chap. 242.—An ACT to regulate the taking and catching of clams for sale
or planting in the waters of the commonwealth.
Approved February 3, 1900.
1. Be it enacted by the general assembly of Virginia, That it shall
be unlawful for any person to take or catch clams for sale or planting
from the waters of the commonwealth of Virginia, except as herein-
after provided. Any resident of the state who has paid the specific tax
of two dollars per annum, and complied with all the requirements of the
oyster laws which entitle him to the privilege of taking and catching
oysters with ordinary oyster tongs from the natural rocks, beds, or shoals
in the waters of the commonwealth, shall also have the privilege of
taking and catching clams for sale or planting in the waters aforesaid for
a period of one year from the beginning of the period fixed by law for
taking and catching oysters from the natural rocks, beds, and shoals
in the waters of the» commonwealth with ordinary tongs: ; or any resident
of the state who has taken out the license and paid the specific license
tax of five dollars and has complied with all the requirements of the law
which entitle him to the privilege of taking and catching oysters with
patent tongs from the natural beds, rocks, and shoals in the waters of
the commonwealth, shall also have the privilege of taking and catching
clams for sale or planting from the waters of the commonwealth for a
like period as that prescribed above: provided, that on the eastern side
of the countics of Accomae and Northampton, any resident of the state
who has complied with all the requirements of the law for taking and
catching oysters on the said eastern side of Accomae and Northampton
counties shall also have the privilege of taking and catching clams for
sale or planting on the said eastern side of Accomac and Northampton
counties for the same period as prescribed above. Any person who shall
take or catch clams for sale or planting from the waters of the common-
wealth, without having first complicd with the provisions of this act,
shall be deemed euilty of a mis “demeanor. and on conviction thereof shall
be fined not less than ten nor more than one hundred dollars.
2. This act shall be in force from its passage.
