Chap. 203.—An ACT to prohibit the killing of fish in Clinch river, in the
county of Russell, with dynamite or other explosive, and to prescribe a
punishment therefor.
In effect January 30, 1900.
1. Be it enacted by the general assembly of Virginia, That it shall
be unlawful for any person to kill fish in Clinch river, in the county of
Russell, by throwing dynamite or other explosives in said river, and upon
conviction thereof such person shall be fined fifty dollars, and shall be
confined in the jail of said county sixty days, and may be required to
workin the chain gang until said fine and costs of prosecution are paid.
One-half of said fine, when collected, shall go to the informer.
2. Be it further enacted, That upon complaint to any justice of the
peace in said county that any person has in his possession for unlawful
purposes dynamite or other explosives, or upon his own suspicion, he
shall cause such person to be summoned, and compel his attendance
before him, and shall examine such person on oath as to the amount
of dynamite or other explosives in his possession and the purposes for
which he is going to use the same, and require such person to file with
him an affidavit that he will not use such dynamite or other explosives for
killing fish in Clinch river in said county, and that he will neither sell
or give the same to another to be used for such unlawful purpose.
3. Upon proof that any person has used dynamite or other explosives
for such unlawful purposes after he shall have filed the affidavit afore-
said, he shall be deemed guilty of perjury, and it shall be the duty of
the attorney for the commonwealth of said county to prosecute such per-
son before any justice of the peace of said county for perjury, and upon
conviction thereof such person shall be punished as provided under the
general laws of the commonwealth.
4, And it is further enacted, That upon the conviction of any person
under this act for perjury the attorney for the commonwealth of said
county shall be entitled to a fee of five dollars, payable by the person so
convicted, and the same shall be taxed in the costs against him.
5. All acts and parts of acts relating to the killing of fish in Clinch
river, in said county, in conflict with this act, are hereby repealed.
6. This act shall be in force from its passage.
