Chap. 200.—An ACT to confirm the action of the city council of Alexandria
of May 12, 1868, granting permission to construct the side-track or switch
on Wilkes street, between Washington street and Saint Asaph street,
Alexandria, Virginia, and to legalize the said switch or the side-track for
the use of C. C. Smoot and sons company, its successors and assigns, own-
ing certain properties abutting on Wilkes street, between Washington and
Pitt streets, Alexandria, Virginia; and making it lawful for the southern
railway company and its successors to use the side-track or switch in
handling and doing the business of the said C. C. Smoot and sons company,
its successors and assigns.

Whereas the common council of Alexandria did, on March sixteenth,
chteen hundred and forty-nine, authorize the Orange and Alexandria
ilroad company (of which the said southern railway company is the
iccessor) to construct and lay down a single track of railway with the
ecessary turnouts on Wilkes street, in Alexandria, Virginia; and
Whereas the general assembly of Virginia, by an act passed March
renty-seventh, eighteen hundred and fifty, did confirm the said action
the common council of Alexandria; and
Whereas the city council of Alexandria on May twelfth, eighteen hun-
‘ed and sixty-eight, did authorize the late firm of C. C. Smoot and sons
f which C. C. Smoot and sons company is the successor) to construct
1d lay down a side-track or switch on Wilkes street, between Washing-
n and Saint Asaph streets; and
Whereas under the said authority of the city council of Alexandria,
1e said side-track or switch connected with the southern railway com-
unv's track on Wilkes street, between Washington and Saint Asaph
reets, Alexandria, Virginia, was constructed and laid down and was
:ed by the said C. C. Smoot and sons and their successor, the said C.
. Smoot and sons company, and also by the said railroad companies,
itil the said southern railway company was enjoined in July, eighteen
indred and ninety-nine, from using the said side-track or switch; and
Whereas the said C. C. Smoot and sons and their successor, the said

C. C. Smoot and sons company, own to the center of Wilkes street, be-
tween said Washington and Saint Asaph streets, where their land abuts
on said street, subject to the right of way of the public over the same
as a street or highw ay, and the caid side-track or switch was constructed
and laid down, and is upon the said land of said C. C. Smoot and sons
company; therefore,
1. Be it enacted by the general assembly of Virginia, That the per-
mission granted by the city ‘council of Alexandria on May twelfth, eigh-
teen hundred and sixty-eicht, to construct the said side-track or switch
on Wilkes street, between W ashington and west side of Saint Asaph
streets, in Alexandria, Virginia, be, and the same is hereby, confirmed.
That the said switch or side-track connected with ihe track of the
southern railway company on Wilkes street, between Washington strect
and west side of Saint Asaph street, in the city of Alexandria, Virginia,
be, and it is hereby, legalized for the use of C. C. Smoot and sons com-
pany, its successors and. assigns, owning the following properties abutting
on the south side of Wilkes strect, hetween Washington and Pitt strects,
and on the north side of Wilkes street, hetween Washington and Saint
Asaph streets, in the city of Alexandria, Virginia, and now belonging to
the said C. C. Smoot and sons company, and it shall be lawful for the said
southern railway company and its successors, and they are hereby author-
ized, to use the said side-track or switch in handling and doing the busi-
ness of C. C. Smoot and sons company, its successors and assigns, and
of the owner of any of the properties above mentioned, but for no other
purpose.
3. This act shall be in force from its passage.
