Chap. 1142.—An ACT to amend and re-enact section 2136 of the code of Vir-
ginia, as to right of owners to plant oysters in any creek, &c., within his
survey.
Approved March 7, 1900.
1. Be it enacted by the general assembly of Virginia, That section
twenty-one hundred and thirty six of the code be amended and _ re-
enacted so as to read as follows:
$2136. Might of owner to plant oysters in anv creek, and so forth,
within his survey.—If any ereck, cove, or inlet, within the jurisdietion
of this commonwealth, makes into or runs through the land of anv
person, and is comprised within the limits of Ins lawful survey, such
person or other lawful oecupant shall have the exclusive right to use
said creck, cove, or inlet for sowing or planting oysters or other shell fish.
This section shall not apply to the county of Mathews; but the
third section of chapter two hundred and fiftv-four, acts eighteen hun-
dred and eighty-three and four, shall continue in force as to said county;
but nothing in this act shall be construed as applying to Milford Haven
and JIorn Harbor, as in anv wav relieving plantine-grounds in said
‘aters from the rental due the state from planting-grounds occupied
as such.
2. This act shall be in force from its passage.
