Chap. 1107.—An ACT to amend and re-enact section 2 of an act approvec
March 3, 1898, entitled an act to incorporate Old Point Comfort college.
Approved March 7, 1900.
1. Be it enacted by the general assembly of Virginia, That the secon:
section of an act approved March third, eighteen hundred and ninety
eizht, entitled an act to incorporate Old Point Comfort college, b
amended and re-enacted so as to read as follows:
$1. Be it enacted by the general assembly of Virginia, That John
B. Vand der Wee, John Griftin, James Hahnel, John G. Ridder, ans
Michael P. Sullivan, and such other persons as they may elect as thei
associates and successors, from the brotherhood known as Xaveriay
brothers of the Roman Catholic church be, and they are hereby, in
corporated and created a body corporate and politic, under the nanny
and stvle of Old Point Comfort. college, for the purpose of the instruc
tion and education of bovs and vouneg men in the higher branches o
learning, and in the arts and sciences, and for their physical and mors
training and improvement as well as the training of their minds.
$2. The said college shall have perpetual succession and a corporat
common seal, which it may alter or amend at its pleasure and in it
corporate name may sue and be sued, contract and be contracted witlt
and may adopt such by-laws, and make such regulations for the trans
action of its business and for the government of all persons and thing
under its authority, for the management of its estate, and the due an
orderly conduct of its affairs as may be requisite and necessary, and as
are not inconsistent with the laws of the state of Virginia and of the
United States.
The said college may construct all buildings, acquire, receive, hold,
and in every legal manner use and enjoy lands, tenements, heredita-
ments, money, goods, and choses in action which may be acquired
by gift, donation, devise, subscription, contract, or purchase: provided,
the said college shall not at any time hold property exceeding in value
the sum of five hundred thousand dollars. The said body corporate
may sell, exchange, and convey any such of its estate as it may deem
est.
S$ 3. The said corporation may establish its college in the county
of Elizabeth City or elsewhere in the state of Virginia, and may estab-
lish branch schools or branch colleges in other parts of this state, and
mav employ such professors and teachers as may be deemed necessary
for the accomplishment of its purposes. and may confer upon the gradu-
ates of the aforesaid college, or upon others, such diplomas, honors, and
degrees as may to it seem proper.
S$ 4. The officers of the said college shall consist of a president, vice-
president, secretary and treasurer, and a board of trustees of not less
than three nor more than thirteen members, who shall be selected
by the members of the said corporation, and such other officers as the
hoard of trustees may elect. The brother provincial of the Xaverian
brothers of America, and his successors, shall always be president of
this corporation.
§ 5. The board of trustees shall elect the vice-president, secretary and
treasurer, and other suitable and necessary officers, at such times, and
in such manner, and on such terms, and for such lengths of time as
the bv-laws may prescribe. And the said hoard of trustees shall control,
amend, enact, or annul the rules and by-laws of said corporation as to
it mav seem proper. The said board of trustees may, at anv time,
by a two-thirds vote, expel anv member of said hoard for good cause.
The president shail have the power of veto over the acts of said board.
In the absence or disability of the president the vice-president may
have such authority as the president would have were he present.
&§ 6. This act shall be in force from its passage.
