Chap. 109.—-An ACT to amend and re-enact section 10 of an act entitled a
act to amend and re-enact an act to incorporate the town of Dayton
approved March 9, 1880, and all acts amendatory thereof, approved Feb
ruary 29, 1892.

1. Be it enacted by the general assembly of Virginia, That sectio1
ten of an act entitled an act to amend and re-enact an act to incorporat
the town of Dayton, approved March ninth, eighteen hundred ane
eichty, and all acts amendatory thereof, approved February twenty-ninth
eighteen hundred and ninety-two, be amended and re-enacted so as t
read as follows:
§ 10. The council shall have power to levy such taxes as it ma.
deem necessary for the purposes of the corporation: provided, that n
tax upon the real and personal property in said town shall exceed fift
cents on the one hundred dollars assessed value thereof, except as here
inafter provided: and provided, also, that no such tax shall be levie
upon the lands, stock of any kind, utensils or instruments within th
limits of said corporation which are used strictly for farming purpose:
but this proviso is not intended to apply to milch cows, horses, an
other animals in domestic use, nor to lands when laid off and sold a
town lots. The council, however, may by a majority vote of all th
members elected thereto, levv a special tax not to exceed twentv-fiv
cents on the one hundred dollars assessed value of real and persond
property subject to corporation tax under this section, for the purpos
of supplementing the public free school funds, to the extent necessary t
continue the public free school of the town of Dayton in all of it
departments for a period of seven months. The said council shall als
have power to collect a fee of fifty cents per month from each pup:
residing without the corporate Limit of said town, and who may attend
the public free school of said town, said fee to be collected for all saen
time as is paid for by the town under the provisions of this act.
