Chap. 100.—An ACT to amend and re-enact section 3271 of the code of Vir-
ginia, in relation to demurrer.

1. Be it enacted by the general assembly of Virginia, That section
thirty-two hundred and seventy-one of the code of Virginia be, and the
same is hereby, amended and re-enacted so as to read as follows:
$3271. Form of demurrer or joinder in demurrer.—The form of
demurrer or joinder in demurrer, may be as follows: “ The defendant (or
plaintiff) says that the declaration (or other pleading) is not (or is)
sutficient in law”: provided, that all demurrers shall be in writing,
except in criminal cases, and in civil cases the court on motion of any
party thereto, shall, or of its own motion may, require the grounds of de-
miurrer relied on to be stated specifically in the demurrer; and no grounds
shall be considered other than those so stated, but either party may
amend his demurrer by stating additional grounds, or otherwise, at any
time before the trial.
2. This act shall be in force from its passage.
