Chap. 876.—An ACT to incorporate the Norfolk and Kempsville turnpike
company.
Approved March 3, 1:98.
1. Be it enacted by the general assembly of Virginia, That W. C. Cobb,
C. R. Nimmo, Aaron Milhado, R. C. Carrington. and A. T. Herbert,
their successors and associates be, and they are hereby, constituted a
body politic and corporate under the name of the Norfolk and Kemps-
ville turnpike company, and by that name shall have perpetual succes-
sion and a corporate seal, which they may make, alter, or amend, and
may sue and be sued, plead and be impleaded, make and execute bonds,
notes, obligations, contracts, and agreements, and buy, sell, take, have
and hold real estate and personal property. They shall have full and
adequate powers to construct a turnpike road from some point at or near
the city of Norfolk, in the state of Virginia, to Kempsville, in the county
of Princess Anne, in the state of Virginia, and to continue the same
from Kempsville to Princess Anne Courthouse, in the said county of
Princess Anne, in the state of Virginia, if sihey shall see fit so to do.
Said turnpike road from the said city ‘of Norfolk to Kempsville, and
from Kempsville to Princess Anne Courthouse, shall be built and con-
structed over such route, and in such direction as the said company shall
deem best, and shall be not less than thirty, nor more than sixty fect in
width.
2. The said company shall have the privilege in making said road, or
any part thereof, to use shell, plank, sand, or any other material, and
shall have the right to provide open ditches on either side of the said
road.
3. Said company in constructing or extending said road or turnpike,
shall have the right with the consent of the court of the county in which
the road lies, to use the bed of any public road, and shall have the
control of the entire width of said road so far as ‘they may extend the
said turnpike along a line of the same; and the said company shall
have power to condemn and use, by compliance with the general laws
in such cases, the private lands of individuals, when it is necessary to
obtain the proper grade or location of the roadbed or gates.
4. Said company is hereby authorized to build lateral or branch roads
in any direction, not exceeding fifteen miles each, with all the privileges
conferred by the preceding section. Said company is hereby authorized
to build and maintain such bridges across Ohio creek, Broad creek, and
any and all other such streams and waters as may be convenient and
necessary: provided, that all said bridges shall be equipped, where it is
convenient and proper so to do, with suitable draw or draws.
Oo. Said company 1s hereby: authorized to erect one or more gates
across said road at such points as it may deem expedient, and to charge,
take, and receive such tolls for the use of said road, or any part thereof,
or any or either of said bridges as the board of directors may determine
and direct. The said company shall have the right herein just above
specified as soon as it shall have completed three or more miles of said
road,
The capital stock of said company shall be not Jess than ten nor
more than twenty-five thousand dollars, to be divided into shares of
fifty dollars each, and the books of subscription shall be opened by W.
C Cobb, Aaron Milhado, and R. C. Carrington, three of the corporators,
or such other persons as they may appoint, at such time and place as
they may select, for the purpose of receiving subscriptions to the capital
stock. When the minimum stock has been subscribed and paid for as
required by Jaw, the said corporators may proceed to organize the com-
pany as provided by law, and to elect officers, and do such other things
as may be necessary and proper for the business of the company.
7. The company is hereby authorized to acquire by donation, condem-
nation, purchase or otherwise such land as may be necessary for the busi-
ness of the company, and to hold, convey, and dispose of the same.
8. This conpany shall have the right to acquire an interest In, or con-
solidate with, any other turnpike or drawbridge company in this state,
and such companies shall have the same rights with regard to this com-
pany.
9. This company shall be Subject to the general laws of the common-
wealth of Virgimia appheable to such a corporation; it shall have all
rights, powers, and privileges necessary for the construction and main-
tenance of a turnpike road to, from, and between the points hereinabove
mentioned; it shall have the right to construct and maintain all neces-
sary bridges, trestles, and other structures, and to erect gates and charge
and receive tolls,
10, All taxes due the commonwealth of Virginia by this company
shall be paid in lawful money of the United States and not in coupons.
11. All acts and parts of acts inconsistent with this act are hereby re-
pealed,
12. This act shall be in force from its passage,
