Chap. 344.—An ACT for the relief of the estate of John H. Knowles, deceased.

Whereas Philip N. Nicholas and William B. Chamberlayne, trustees
of certain lands of which Patrick Coutts died seized, and which es-
cheated to the commonwealth of Virginia, acting by authority of an act
of the general assembly of Virginia passed February twenty-third,
eighteen hundred and eighteen, conveyed to Pleasant W. Harwood lot
number seven hundred and thirty- two, on corner Canal and First streets,
In the city of Rachmond, Virginia, in consideration of the sum of elcht
hundred dollars, evidenced by the three negotiable notes In equal por-
tions of said Pleasant W. Harwood, and endorsed by John H. Jude, all
of which notes were dated August thirteenth, eighteen hundred and
eighteen, and payable at one, two and three years, respectively, at the
Bank of Vi Irginia, and) ow hich said conveyance is dated August thiur-
teenth, cighteen hundred and eighteen, and duly recorded in clerk's
ollice of the chancery court of the city of Richmond, in deed-bovok
number fifteen, page three hundred and sixty-one; and
Whereas said) Pleasant W. Harwood, by deed dated August thir-
teenth, eighteen hundred and eighteen, and duly recorded in said clerk’s
office in decd-book number fifteen, page one hundred and eighty-nine,
conveved said Jot number seven hundred and thirty-two to said Philip
NX. Nicholas and William B. Chamberlayne, in trust to secure the pay-
ment of said purchase money, evidenced by said notes as aforesaid; and
Whereas by deed dated May second, eighteen hundred and fifty-five,
and of record in the clerk's office of the ‘chancery court of the city of
Richmond, a portion of said lot number seven hundred and thirty-two,
haimely, fifty-seven feet at the southwest corner of Canal and First
streets, was conveyed to John H. Knowles, now deceased, and is now
held by said estate and the grantees of said John H. Knowles; and
Whereas a search has been made in said clerk’s office for a release of
sald deed of trust, but without success; and
Whereas all the partics to said deed of trust have been dead for many
vears, and there is, therefore, no means of showing payment by oral
testimony; and
Whereas seventy-five years having elapsed since the last of said notes
became due and payable, the presumption of their payment is so strong
as to warrant the conclusion of actual payment: therefore,
1. Be it enacted by the general assembly of Virsinia, That the
Clerk of the chancery court of the city of Ric shmond be, and he is
hereby, directed to enter on the margin of page one hundred and
elvhty-nine of deed-book number fifteen, in his said oflice, that the said
debt of eighteen hundred dollars, and all interest thereon, the payment
of which was secured by said deed of August thirteen, eighteen hun-
dred and cighteen, from said Pleasant W. Harwood to said Philip N.
Nicholas and William B. Ch: imberlayne has been paid and discharged;
which entry, when so made, shall operate as a release of said deed of
trust of reeurd in said deed-book number fifteen, page one hundred and
elghty-nine.
