Chap. 232.—An ACT for the protection of assignees, transferees or endorsers af
debts secured on real estate by mortgage, deed of trust, vendor’s or mechanic's
hen.

1. Be it enacted by the general assembly of Virginia, That whenever
any debt secured on real estate by mortgage, deed ‘of trus st, vendor’s or
mechanic's lien has been assigned, transferred, or endorsed to another in
whole or in part by the original payee thereof, such payee may cause a
memorandum or statement of the assignment by him to such assignee,
transferree or endorsee, to be entered on the margin of the page in the
book where such ineumbrance sec uring the same is recorded, which mem-
orandum or statement shall be signed by the assignor, transferrer or
indorser, his duly authorized agent or attorney, and when so signed,
and the signature thereto attested by the clerk in whose office such in-
“unobrance is recorded, [the same shall operate adwinotice of such assign-
nent and transfer, and all the rights and equities of said assignee, trans-
eree or endorsee to the benefits of such incumbrance as of the date
hereof to any purchaser of real estate on which such incumbrance is
2 lien which is situated in the county or corporation in the clerk’s office
»f which such entry has been made, or person dealing with such real
>state in any manner whatsoever in the same manner as if such pur-
shaser or person had actual notice thereof as of said date.
2. And where such transfer by the payee is so entered on the margin
»f the deed book, subsequent transfers thereof may likewise be entered
in the same manner and with like effect.
3. This act shall be in force from its passage.
