Chap. 812.—An ACT for working the public roads in the counties of Gloucester
and Mathews.
Approved March 8, 1894,
1. Be it enacted by the general assembly of Virginia, That the
board of supervisors of the counties of Gloucester and Mathews be,
and they are hereby, authorized to levy a tax not exceeding twenty
cents on each one hundred dollars’ worth of taxable property in said
counties, and this tax shall be known as a road tax. The county
treasurer of each of the said counties shall keep separate the funds
that are collected from this tax in each of the magisterial districts
of said counties, and the said tax shall be expended for keeping in
repair the public roads of the magisterial districts in which they
were collected in the manner herein provided.
2. The county courts of the counties of Gloucester and Mathews,
respectively, are authorized to appoint a road superintendent in their
respective counties, and it shall be his duty to keep in order the
public roads in his county. To this end the road superintendent is
hereby directed to proceed to advertise in such manner as may seem
best to him for proposals for keeping in repair the public roads in
his county, and when such proposals shall have been received he
shall award contracts to the lowest responsible bidders, and execute
contracts with such bidders, who shall execute bonds with approved
security for the faithful performance of the work. It shall be the
duty of the road superintendent to inspect said work from time to
time as he may deem necessary, and pay for the same by drawing
his warrants upon the county treasurer of his county, who shall pay
said warrants out of the funds derived from the road tax provided
for in section one of this act.
3. The superintendent shall execute separate contracts for each
magisterial district in his county for the term of four years, but the
said road superintendent shall have power and authority to cancel
any contract at the expiration of any one yearif the same be net
faithfully and properly executed. It shall be the duty of the road
superintendent to pay for the work contracted for in semi-annual in-
stalments, provided the work has been properly executed according
to contract.
4. If in the judgment of the road superintendent any contractor
under section three fails in the faithful performance of his duty,
said road superintendent shall report the same to the common-
wealth’s attorney of his eounty, whose duty it shall be to bring ac-
tion on the bond given by said contractor for. the faithful perform-
ance of his duty, and for this service said commonwealth’s attorney
shall receive a fee of ten dollars, to be taxed in the cost of this suit.
Each road superintendent under this act shall receive as compensa-
tion for his services the sum of two hundred dollars per annum.
5. The road superintendent shall give a bond in the penalty of one
thousand dollars before the court, payable to the commonwealth, as
the law directs.
6. All acts or parts of acts not in conformity with this act are
hereby repealed.
7. This act shall be in force as soon as it is approved by the board
of supervisors and the judges of the respective counties.
