Chap. 788.—An ACT to restrain and suppress the illegal and unlawful sale of
ardent spirits on Sunday in the county of Warwick.
Approved March 7, 1894.
1. Be it enacted by the general assembly of Virginia, That in all
bar-rooms, ordinaries and saloons at which spirituous or malt liquors,
or any mixture thereof, are sold in the county of Warwick, all screens
and painted and stained windows and all obstructions which hinder,
prevent or interfere with an easy and unobstructed view of said bar-
room, ordinary or saloon from the highway, street or thoroughfare
upon which the same may be situate, be removed from twelve o’clock
on every Saturday night till sunrise of the succeeding Monday morn-
ing, so that the bar-room, ordinary or saloon shall present a clear and
unobstructed view throughout to the public traveling on the said
highway, street or thoroughfare.
2. Be it further enacted, That any person violating any of the
provisions of this act shall be deemed guilty of a misdemeanor, and,
upon conviction thereof, shall be fined not less than five nor more
than fifty dollars.
3. Be it further enacted, That any justice of the peace shall, with
the consent of the accused, have jurisdiction to try cases under this
act, but the accused shall have the right to appeal to the county
court, and shall, unless let to bail, be committed to jail by the jus-
tice until the next term of such court, and the witnesses recognized
to appear at the same time.
4. Be it further enacted, That unless the bar-room, ordinary or
saloon shall be so constructed as to enable the applicant to comply
with the provisions of the first section of this act his place of busi-
ness shall not be deemed a suitable place for the sale of ardent
spirits or malt liquors under the provisions of chapter two hundred
and forty-four of the acts of eighteen hundred and eighty-nine and
eighteen hundred and ninety of the state of Virginia.
5. This act shall be in force from ita passage.
