Chap. 780.—An ACT to relieve the Washington county road board of expenses
incurred under section 25, chapter 357, of acts of the general assembly of
1891-92, approved February 25, 1892.

Whereas the Washington county road board, under and by virtue
of section twenty-five, chapter three hundred and fifty-seven, session
acts eighteen hundred and ninety-one and eighteen hundred and
ninety-two, of an act entitled an act to provide for the working of
roads in Washington county, approved February twenty-fifth, eigh-
teen hundred and ninety-two, did enter into a contract with the gov-
ernor of Virginia for the hire of thirty convicts; and
Whereas the said governor did, under said contract, on the day
of , eighteen hundred and ninety-two, furnish and deliver to
said board the said number of convicts; and
Whereas the said board did receive from the state payment for the
services of the guard and surgeon, as provided for under the pro-
visions of said act, up to the first day of July, eighteen hundred and
ninety-two; and
Whereas warrants were drawn on the state for the continued ser-
vices of said guard and surgeon for the quarter ending September
thirtieth, eighteen hundred and ninety-two, as provided for by said
act; an
Whereas payment was refused by the auditor of public accounts of
said warrants, pursuant to instructions from the said governor, that
by reason said act, in its passage, did not conform to the constitu-
tion, article ten, section eleven, the said section twenty-five of said
act was unconstitutional; and
Whereas the said board notified the said governor that, by reason
of said refusal to pay the said warrants, the said board had no funds
under said act to pay for the services of said guards and surgeon,
and requested the said governor to receive said convicts from said
board; and
Whereas said convicts were not sent for until the tenth day of
December, eighteen hundred and ninety-two; and
Whereas the said board was requested to hold said convicts until
sent for; and
Whereas the said board, by reason of said refusal to pay said
warrants, and by reason of said request to hold said convicts, was
obliged to lay out and expend, out of the general road tax levied un-
der said act, the sum of nine hundred and six dollars and sixty-six
cents in payment for the services of said guard and surgeon: there-
fore,
1. Be it enacted by the general assembly of Virginia, That the
said sum of nine hundred and six dollars and sixty-six cents, ex-
pended as aforesaid for the payment of said guard and surgeon, be
refunded to the said board; and that the said auditor of public ac-
counts of the state is directed to pay the said sum of nine hundred
and six dollars and sixty-six cents, upon a warrant drawn on him
by the judge of the county court of said county, and the said judge
shall pay the same over to the said board, which shall be expended
by it in working the roads of said county under the provisions of
aid act.
2. This act shall be in force from its passage.
