Chap. 695.—An ACT authorizing the judge of the county court of Giles county
to appoint a board of county road commissioners for Giles county.
Approved March‘5, 18%.
1. Be it enacted by the general assembly of Virginia, That it shall
be the duty of the county court of the county of Giles, at the June
term thereof, eighteen hundred and ninety-four, and every two years
thereafter, to appoint four citizens of said county, one from each
magisterial district therein, who ghal! constitute a board to be known
as the board of county road commissioners, who shall qualify in
said court, and whose term of office shall be two years from the date
of their qualification, or until their successors are duly appointed
and qualified. Said board shall select one of their members as chair-
man, and the clerk of the county court of Giles county shall keep a
record of their proceedings in a book to be kept for that purpose.
Said board shall meet at the court-house of said county at least three
times a year, or oftener if they deem it proper.
2. Said hoard shail have the entire management and control of the
working and keeping in repair all the roads of said county, and also
the building of new roads or changes in roads after any road has
been established or changed, as is now provided by law for the es-
tablishment of new roads or the changing of same. The said open-
ing, changing, working or keeping in repair of said roads shall be
by the appointment of road overseers by said board as to all or any
part of said roads, by chain-gang labor or by letting to contract of
all or any part of said roads or otherwise, as said board shall pre-
scribe.
3. The building or repairing of any bridge or footway in said
county shall be done in the manner’ as shall be prescribed by said
board, after any bridge shall have been directed to be built as now
prescribed by law. a
4. For the purpose of opening, changing, working and keeping in
repair the roads of said county, and for the purpose of building or
repairing any bridge or footway in said county, it shall be the duty
of the board of supervisors of said county to levy an annual tax of
not exceeding twenty-five cents on the one hundred dollars’ worth of
all taxable property in said county, both real and personal.
5. Each member of said board shall at each regular meeting
thereof make a written report of all moneys expended under this
act in his district, by whom expended, for what purpose, and the
amounts due and to whom due. Said reports shall be filed by the
clerk and kept as other records are preserved, and upon the con-
firmation of said reports by said board all amounts found due shall
be audited by the clerk and the same certified to the board of super-
visors, who shall issue their warrants to the parties entitled thereto
as other warrants are now issued, and the same shall be paid by the
treasurer of Giles county out of said road fund as other warrants are
now paid.
G6. AnyS person appointed overseer of roads by said board, or re-
ceiving any contract under this act, shall execute a bond payable to
said board in any amount to be prescribed by said board, upon which
said board shal] have a right to sue upon any forfeiture thereof ;
and any road overseer or contractor acting under the provisions of
this act, upon failure to perform his duty, shall be amenable to all
the penalties of the law now prescribed for the punishment of road
overseers for the failure to perform their duties.
7. The compensation of each member of said board shall be twenty-
five dollars per annum, payable out of said road fund, and no mem-
ber of said board shall be, directly or indirectly, interested in any
contract to be given under the provisions of this act.
8. No appointment of any road overseer or contract made under
this act shall be for a period longer than two years.
9. This act shall be in force on and after the first day of June,
eighteen hundred and ninety-four.
