Chap. 644.—An ACT to incorporate the Alexandria county light, water and
power company.
Approved March 5, 1894.
1. Be it enacted by the general assembly of Virginia, That Robert
H. Lamborn and Walter Hinchman, of New York city; H. R. Du-
Janey, H. H. Wells and John Critcher, of Alexandria; and B. H.
Warder, Charles S. Bradley and James H. Embrey, of Washington,
District of Columbia, or a majority of them, and their successors,
are hereby created a body corporate, to be known as the Alexandria
county light, water and power company, with a capital stock of one
hundred thousand dollars, which may be increased not to exceed one
million dollars, in shares of one hundred dollars.
2. That the said company shall have power to construct suitable
reservoirs, canals, pumping stations and factories, and to lay and
construct mains and supply pipes for water and gas, and erect suit-
able poles and wire for power and electric lighting in, through or
along the public roads or streets of the said county and adjoining
county of Fairfax, and to make such excavations in the said streets
or roads as may be necessary for the construction, extension or
maintenance of the said works: provided that the said company
shall protect all trenches or openings and excavations it may make,
in such manner as may be necessary to prevent persons or animals
from falling into the same, and shall] restore such roads and streets
to the same and as good condition as before such openings, trenches
or excavations were made.
3. That the said company shall have the right to supply the houses
now built or to be built, or other premises in the said county, with
water, illuminating or electric light or power, under such regulations
and charges as the board of directors of said company may from
time to time establish.
4, That the said company shall have the right to take a supply of
water from the Potomac river, above the aqueduct bridge, and to con-
struct suitable gate-houses, locks, dams, aqueducts, or canals there-
from, and to acquire by condemnation or by purchase any land or
ways for the structures or other purposes of the company.
5. That it shall be a misdemeanor, punishable with fine and im-
prisonment, for any person to willfully obstruct, injure, or destroy
any of the works of said company.
6. That the said company shall elect annually a board of not less
than five or more than seven directors, who may make or modify such
by-laws, rules, and regulations and schedules of charges as they may
from time to time deem necessary; and shall have the right to issue
bonds, to be secured by a mortgage of its property and franchises,
not to exceed the amount of its paid-up capital, and shall enjoy such
further powers and privileges as are conferred on other corporations
by the general laws of Virginia.
7. That the said company shall begin the construction of its works
within one year from the passage of this act, and be prepared to
supply water and electric power, or gas or electric light, in the county
of Alexandria within two years from the passage of this act.
8. That said company shall have the right to connect its works or
fixtures with those of any other company, upon such terms and con-
ditions as may be agreed upon, and to supply water, gas, electric
light or power in Alexandria county or the county of Fairfax or the
District of Columbia.
9. That the general assembly of Virginia reserves the right to re-
quire said company to make such extensions of its works and struc-
tures as shall promote their public use and convenience.
10. That no excavation, trench or opening shall be made, or line
of poles erected in any road or street except under such restrictions
and regulations as may be prescribed by the board of supervisors and
approved by the county courts of Alexandria and Fairfax counties
respectively.
11. This act shall be in force from its passage.
