Chap. 526.—An ACT to incorporate the Norton street railway company, in
Wise county.
Approved March 1, 1894.
Whereas by an act of the general assembly of Virginia, ap-
proved January sixteenth, eighteen hundred and ninety-two, the
incorporators, W. A. Ayers, F. Kerr Ffolliett, C. F. Flanary, C. F.
Hagan, P. H. Rover, I. S. Ross and E. P. Tate, and their associates
and successors, were constituted a body corporate by the name and
style of the Norton street railway company, and by section second
of said act the said company was empowered and authorized to con-
struct, equip, maintain and operate a street railway in and along
any of the streets or roads within the proposed town of Norton, known
as East Norton and West Norton, Wise county, Virginia; and
whereas, owing to the financial pressure which has existed since the
passage of said act, no work has yet been done on said street rail-
way: it is, therefore, hereby enacted, and—
1. Be it enacted by the general assembly of Virginia, That P. H.
Rover, C. F. Hagan, C. F. Flanary, E. P. Tate, Samuel Bond and O.
B. Gilley, and their associates and successors, be, and they are hereby,
constituted a body corporate by the name and style of the Norton
street railway company.
2. The said company shall have power and authority to construct,
equip, maintain and operate a street railway in and along any of
the streets or roads within the proposed town of Norton, and extend-
ing eastwardly to Gladeville and westwardly to Little Stone Gap,
with branch lines extending five miles on each side of the main line
in Wise county, Virginia.
8. It shall be lawful for the said company to transport passen-
gers, freights of all kinds, baggage and United States mails over the
line of their railway and to collect fare and toll for same, and may use
horse, steam or electric power or cable or other power to propel the
cars on its road.
4, The capital stock of said company shall not be less that two
thousand five hundred dollars nor more than seventy-five thousand
dollars, to be divided into shares of fifty dollars each.
5. The said company may acquire and own real estate not to ex-
ceed five hundred acres, and shall always have its principal office in
the town of Norton.
6. The said company shall have power and authority to lease its
road or roads, and to borrow money for the use of the corporation,
and to secure such loans by deed of trust or mortgage on all or part of
ita real estate and franchises and income.
7. Said company shall have power and authority to consolidate
with and co-operate with any railway or street railway company in-
corporated under the laws of Virginia.
8. The incorporators hereinbefore named shall constitute the first
board of directors of said company, and, until their successors are
elected by the stockholders, shall manage the affairs of said company ;
and said company shall pay its taxes in money and not in coupons.
9. Said company shall begin the construction of the road within
two years from the granting of this charter and complete the same
within five years from said date. The work of construction shall be
begun within the limits of the town of Norton, subject to the con-
trol and supervision of the council of said town, as provided by the
charter thereof, or by general law.
10. The act of incorporation referred to and approved January
sixteenth, eighteen hundred and ninety-two, is hereby repealed.
11. This act shall be in force from its passage; but the legislature
reserves the right to amend, alter or repeal this charter at any time.
