Chap. 411.—An ACT placing J. H. Stewart and George A. McAllister on the
onfederate pension list.

Whereas it is represented that J. H. Stewart, a Confederate soldier
and a private in the eleventh regiment Virginia cavalry, and a resi-
dent of Bath county, was, by reason of service in the army, disabled
by a gun-shot wound while in said service; and George A. McAllis-
ter, a Confederate soldier and a private in the thirty-first Virginia
infantry, and a resident of Highland county, was, by reason of ser-
vice in the army, disabled by wounds received in battle—not in the
class described in the general statutes as entitled to pensions—are
rendered helpless to a degree that justly entitles them to receive a
pension: therefore,
1. Be it enacted by the general assembly of Virginia, That the
auditor of public accounts be, and he is hereby, directed to Jist the
said J. H. Stewart and George A. McAllister for the pension allowed
to disabled soldiers: provided, however, that before the name of
either of them shall be placed on said list he shall prove before the
county court of his county, by competent and sufficient testimony,
that he is suffering from a disability equal to that of the loss of a
leg or eye or an arm, with respect to incapacitating him from
manual labor, and that such disability is the result of a wound re-
ceived while in the military service of the state, and shall produce
to the auditor of public accounts the certificate of such court to that
effect, and that such court is satisfied of the truth and correctness
of the same, and, further, that the applicant has made oath that he
has not an annual income of as much as three hundred dollars per
year, nor has he property of the assessed value of as much as one
thousand dollars; and the auditor, in such event, shall list them as
partially or wholly disabled soldiers, as the case may be.
2. This act shall be in force from its passage.
