Chap. 380.—An ACT to determine the necessity of a lawful fence and estab-
lish same between adjoining lands in Rockingham county.

Whereas it becomes necessary in particular cases to erect line
fences between adjoining lands in the county of Rockingham where
the line has been made the lawful fence, according to section twenty
hundred and ninety-eight, chapter ninety-three of the code of eigh-
teen hundred and eighty-seven, or where owners of adjoining lands
have chosen to let such lands lie open, according to section twenty
hundred and fifty-three, chapter ninefy-three, of the code of eigh-
teen hundred and eighty-seven: therefore,
1. Be it enacted by the general assembly of Virginia, That where a
dispute arises between adjoining land-owners as to the necessity of
a lawful fence between such adjoining lands the same shall be deter-
mined by the parties selecting three persons upon whom they may
agree to determine the necessity of such a fence, but in case such
land-owners will not agree to select such persons to settle these dis-
putes, then either of such land-owners may apply to the county
court, who may appoint three disinterested freeholders to determine
the necessity of a lawful fence at place in dispute after reasonable
notice has been given the other land-owners. An agreement of the
majority of such persons appointed hy the court shall be sufficient
to decide the necessity for a lawful fence, and when found necessary
such a fence shall be erected, and on such conditions as fixed by the
general law, and the provisions for enforcing the general law shall
be the provisions for enforcing this act.
2. Each person appointed by the court to settle these disputes
shall receive one dollar per day for each day of actual services ren-
dered when thus engaged, such amounts to be recovered from party
against whom these disputes are decided.
3. This act shall be in force from its passage.
