Chap. 357.—An ACT to incorporate the Buckroe, Phceebus and Hampton rail-
road company.
Approved February 23, 1894.
1. Be it enacted by the general assembly of Virginia, That J. A.
Watkins, George Booker, Matthew Armstrong, R. M. Booker, C. T.
Holtzclaw, W. T. Gatewood, John B. Lake, P. T. Woodfin, R. E.
Boykin and Irwin Tucker, and such other persons as may be associ-
ated with them, and their successors, be, and they are hereby, consti-
tuted a body corporate and politic by the name of the Buckroe,
Phebus and Hampton railroad company.
2. The capital stock of the said company shall not be less than
ten thousand dollars, or more than three hundred thousand dollars,
to be divided into shares of not less than ten nor more than one
hundred dollars each.
3. The said company shall have power and authority to construct,
equip, maintain and operate a railroad in the county of Elizabeth
City, in the state of Virginia, from Hampton wharf, in the town of
Hampton, along the line of King street to Mallory avenue; thence
along Mallory avenue to Hampton river; thence across Hampton
river to the lands of the East Hampton development company ;
thence through the lands of the said company, in an easterly direc-
tion, to the main county road terminating at Mellon’s store; thence
along said road, or by some route parallel thereto, to said Mellon’s
store; thence to the southern branch of the national home for disabled
volunteer soldiers; thence through the soldier’s home to Asylum street
in Chesapeake City; thence along Asylum street to Mallory street ;
thence along Mallory street and Mallory street extended to Buckroe,
on Chesapeake bay, with like power and authority to construct, main-
tain and operate a branch road from Mallory avenue along the pub-
lic highway to the Chesapeake and Ohio railroad depot.
4, The said company shall have the power and authorit¥ to begin
the construction of the said railroad at any point along its proposed
route, and may use and operate the same from the time it shall have
been commenced.
5. It shall be lawful for the said company to transport passengers,
freight and baggage, and collect fare and tolls therefor, and use in
the propulsion of cars on its road either horses, mules, steam or elec-
tricity as a power, and, in general, have all such other powers, privi-
leges, rights and franchises that may be necessary for the accom-
plishment of the purposes of its incorporation which are conferred
by the laws of Virginia upon works of internal improvement.
6. The said company shal! have power to acquire by purchase, lease,
or condemnation, according to law, all lands required for a right of
way for its railroad, and for stations, depots and terminal facilities,
for its operation ; borrow money for its use, issue bonds and notes
therefor, and secure such bonds or notes by deed or deeds of trust or
mortgage or mortgages on any part or all of its property and fran-
chises.
7. The said company may also acquire, purchase, accept, hold, en-
joy and convey such other property, real, personal or mixed, as may
be necessary or useful for the purposes of its business: provided
that it, shall not acquire or hold real estate in excess of five hundred
acres.
8. The said company shall have power to cross any other railroad
upon the terms and in the manner prescribed by the general law for
one work of internal improvement crossing another, or may unite
with any other railroad now built or constructed, or hereafter to be
built or constructed, upon such terms as may be agreed upon with
said railroad, and, with the consent of the council of the town of
Hampton and the board of supervisors of the said county, respec-
tively, may use any public streets of the said town or any public
roads in said county along its route not heretofore designated in
this act. .
9. The incorporators herein named, or any five of them, after due
and reasonable notice of the same shall have been given, shall pro-
ceed to receive subscriptions to the stock of the said company, and
when the minimum amount of said stock shall have been subscribed,
such subscribers may organize and shall be authorized to proceed
with the construction of the said railroad.
10. The said company shall commence the construction of said
road within two years, and complete the same within five years from
the passage of this act.
11. All taxes due by the said company shall be paid in lawful
money of the United States.
12. This act shall be in force from its passage.
