Chap. 33.—An ACT providing for the retirement of bonds held by the trustees
of St. Joseph’s academy, and orphan asylum of Riehmond, and the issuing of
reyistered certificates therefor.
Approved January 15, 184.
Whereas D. Hl. Gregg, late of King William county, Virginia, did
by his last will and testament which was admitted to probate, Octo-
ber tenth, eighteen hundred and eighty-five, bequeath amongst other
securities, to the board of trustees of St. Joseph's academy and
orphan asylum of Richmond, Virginia, five thousand dollars of the
ten-forty bonds of the state of Virginia, “in trust, as a permanent
fund, to be known as the Gregg donation, and as the foundation of
a fund, the income or profits thereof to be applied by the manayers
of said association to the maintenance, education and tadustrial train-
ing of destitute female orphan children, of any and every denomi-
nation and nationality of ‘Caucasian race’; and whereas no interest
has been paid upon the said bonds since they came into the possession
of the said trustees, and the state has by an act of assembly
approved February twenty-third, eighteen hundred and ninety-two,
declared it to be the settled policy of the state to encourage these etforts
for the education of her citizens and to co-operate with the generous
donor of her bonds, by paying full interest thereon, so long as they
shall be held as endowments for educational purposes,” and further
declared by said act that “it is proper that all obligations of the
state held by schools and colleges be of the same character and on
the same footing”: therefore,
1. Be it enacted by the general assembly of Virginia, That the
trustees of St. Joseph’s academy and orphan asylum shall, on or
before the first day of July, eighteen hundred and ninety -four, sur-
render to the second auditor five thousand dollars of the ten- forty
bonds of the state of Virginia, which it holds as an endowment for
educational purposes.
2. That said auditor shall treat said bonds in all respects and issue
a registered certificate of debt therefor as provided by the act
approved February twenty-three, eighteen hundred and ninety-two,
entitled “an act for the retirement of bonds held by schools and
colleges, and the issuing of registered certificates therefor and pro-
viding for the payment of interest thereon.” The said certificate
shall embrace the arrearages of coupons, attached to said bonds;
and the second auditor shall, upon the firat dav of January and Julv
of each year, draw his warrant upon the auditor of public accounts
in favor of “the trustees of St. Joseph’s academy and orphan asylum
of Richmond,” for the interest upon said certificate at the rate of
four per centum per annum.
3. This act shall be in force from its passage.
Chap. 34—An ACT to amend and re-enact sections 1 and 2 of an act entitled
an act to amend and re-enact sections 1, 2, 3, 4,7 and 10 of the charter of
the Newport News light and water company.

1. Be it enacted by the general assembly of Virginia, That sec-
tions one and two of an act entitled an act to amend and re-enact
sections one, two, three, four, seven and ten of the charter of the
Newport News light and water company, approved January ninth,
eighteen hundred and ninety-two, be amended and re-enacted so as
to read as follows, to-wit: -
8 1. That C. P. Huntington, I. E. Gates, F. H. Davis, Edward St.
John and C. B. Orcutt, and such other persons as may be hereafter
associated with them, their successors and assigns, shall be, and they
are hereby, incorporated and made a body politic and corporate under
the name and style of the “Newport News light and water com-
pany,” for the purpose of supplying and distributing water from
natural streams, water courses, subterranean springs or from other
sources for public or private use within the limits of Newport News,
in the county of Warwick, state of Virginia, and at such other place
or places within the said county of Warwick, and within the coun-
ties of York, James City (excluding the city of Williamsburg), and
within the county of Elizabeth City, including the town of Hamp-
ton, In said state, and with the consent of the proper authorities of
the United States government, within the territory of the ‘ National
home for disabled volunteer soldiers,” and at Old Point Comfort, in
the said county of Elizabeth City, as may be determined on from time
to time by the said company; and also for the further purpose of
manufacturing and distributing gas or electricity for power and
light for public and private use within the limits of Newport News,
in the said county of Warwick, and at such other place or places
within the said county of Warwick and within the said counties of
York and James City (excluding the city of Williamsburg) as may
be determined on from time to time by said company, and by the
name and style aforesaid the said C. P. Huntington, I. E. Gates,
F H. Davis, Edward St. John, and C. B. Orcutt, and their asso-
ciates, successors and assigns, shall be known in law and shall
have perpetual succession and a common seal, which may from
time to time be changed by the said company; may sue and be
sued, plead and be impleaded, contract and be contracted with, and
shall have, enjoy and exercise all the rights, powers and privileges
proper, requisite and necessary for the purposes of this act, not in-
consistent with the laws of Virginia, or of the United States, or which
are conferred by the laws of the state of Virginia upon companies
incorporated for works of internal improvement or other incorpora-
ted companies,
<2. That the said company shall have full power and authority
upon payment of just compensation as provided by law to construct,
use, employ, lay and locate on any plan if may approve, dams, reser-
voirs, cisterns, force-pumps, engines, pipes and any and all fixtures,
appurtenances and appliances proper, necessary or desirable for the
drawing, storage, conveyance and distribution of water, subject to the
provisions of section one of this act, within the limitsof Newport News,
in the said county of Warwick, and at such other place or places with-

including the town of Hampton, and at the said “ National home for
disabled volunteer soldiers,” and at Old Point Comfort, in said state,
as may be determined on from time to time by the said company.
And the said company shall have full power and authority, upon pay-
ment of just compensation as provided by Jaw, to construct, use,
employ, lay and locate on any plan it may approve, any and all en-
gines, machinery, poles, wires and other fixtures, appurtenances and
appliances proper, necessary or desirable for the manufacture, gen-
eration, conveyance and distribution of gas or electricity, subject to
the provision of section one of this act, within the limits of New-
port News, in the said county of Warwick, and at such other place or
places within the said county of Warwick, and within the said
counties of York and James City (excluding the city of Williams-
burg) as may be determined on from time to time by the said com-
pany.
And the said company shall have full power and authority, with
the consent of the boards of supervisors and of the county courts, re-
spectively, of the counties hereinafter named, to lay all necessary
pipes, main and lateral, for the conveyance and distribution of water
along, on and under the public roads within the limits of Newport
News, in the said county of Warwick, and within the said counties
of Warwick, York, James City (excluding the city of Williamsburg)
and Elizabeth City, and with the consent of the council of the said
town of ILampton, to lay all necessary pipes, main and lateral, for
the conveyance and distribution of water along, on and under the
streets and alleysof the said townof Hampton, subject, however, to the
fee-simple rights of adjacent land-owners in and to said roads, streets
and alleys, which said right of way the said company shall acquire by
gift, purchase or condemnation in manner prescribed by section
twelve hundred and eighty-eight and twelve hundred and eighty-nine
of the code of Virginia, and the said company, with the consent of
the hoard of supervisors and of the county court of the said county
of Warwick, and subject to the fee-simple rights of adjacent land-
owners therein, which said rights of way the said company shall ac-
quire as hereinbefore provided, shall have full power and authority
to erect and locate its poles and wires for the conveyance and distri-
bution of electricity along, on and under the public roads of the said
county of Warwick. And the-said company is further authorized
and empowered to lay, locate and construct its pipes for the convey-
ance and distribution of water across Hampton river and Mill creek,
in the said county of Elizabeth City, above or beneath the surface
of the water of said rivers: provided that said pipes shall not in
any wise obstruct or interfere with the free navigation of said rivers,
and for the purposes of thig act the said company shall and is here-
by expressly invested with all the powers, rights, privileges and fran-
chises conferred and subject to all the restrictions imposed by chapter
forty-six of the code of Virginia, eighteen hundred and eighty-seven,
and the acts of the general assembly of Virginia amendatory thereof,
and other laws of the state of Virginia as far as applicable.
2. This act shall be in force from its passage.
