Chap. 227.—An ACT to ratify, validate and confirm the payment of certain fees
heretofore paid to the state for and in connection with certain charters
granted by the courts.
Approved February 12, 1894.
1. Be it enacted by the general assembly of Virginia, That whereas
an act was passed on February tenth, eighteen hundred and ninety,
requiring the payment of fees on certain charters, which act was
amended and re-enacted by an act passed February twenty-eighth,
eighteen hundred and ninety; and whereas the supreme court of this
state has decided that, as the result of the inadvertent omission of
certain words in the amending statute, the state had no longer the
right to require the payment of fees on charters granted by the
courts; and whereas it was never the purpose of the general assem-
liv to relieve court charters from the payment of fees, it being
clearly shown in the progress of the case that came before the su-
preme court that the omission aforesaid was an inadvertence; and
whereas many charters were granted by the courts under the act of
February twenty-eighth, eighteen hundred and ninety, before the
same was amended and re-enacted by an act passed February six-
teenth, eighteen hundred and ninety-two, and the fees on these char-
ters so pranted under the act of February twenty-eighth, eighteen
hundred and ninety, have been paid to the state; and whereas
these fees were reasonable and proper, and their payment in con-
furmity with the real intention of the general assembly: now, there-
fore, the general assembly of Virginia doth validate, ratify and con-
firm the payments aforesaid, making the collection and receipt
thereof by the state as valid and effectual a collection, for all pur-
poses, as if the same had been made under the act of February six-
teenth, eighteen hundred and ninety-two, or any other act of the
general assembly of Virginia clearly requiring the payment of fees
for and in connection with charters granted by the courts.
2. This act shall be in force from its passage.
