Chap. 117.—An ACT to enlarge the powers of the corporation of Waynesboro,
Virginia, in regard to the interment of the dead.
Approved February 1, 1894
1. Be it enacted by the general assembly of Virginia, That it shall
be lawful for the council of the town of Waynesboro to issue its
bonds for an amount not less than two thousand dollars, nor more
than four thousand dollars, for the purpose of purchasing suitable
grounds for the burial of the dead, and for laying off the same into
lots and making proper improvements thereon, but before issuing any
bonds under this act, the said council shal] conform in all respects
to section twenty-three of chapter one hundred and two of acts of
assembly, eighteen hundred and ninety-one and eighteen hundred
and ninety-two, approved January twenty-sixth, eighteen hundred
and ninety-two, entitled an act to amend and re-enact the charter of
the town of Waynesboro.
2. Be it further enacted, That the said council may purchase not
legs than five nor more than twenty acres of land for the purpose of
a cemetery, which land shall be situated within one mile of the cor-
porate limits of said town, and should the council of said town not
be able to make such purchase, it shall have the power to condemn
not less than five nor more than twenty acres of land for the pur-
poses aforesaid, but in making such condemnation said council sha)!
conform to the general laws of the state governing the taking of pri-
vate property for public uses; but it shall not in any case take any
yard, garden or orchard, or any part thereof, without the consent of
the owner.
3. Be it further enacted, That the council of said town shal] elect
three trustees, or commissioners, who shall hold their offices for the
period of two years, or until their successors are elected by said coun-
cil. Said trustees or commissioners shal] have the right and power to
make rules and regulations to govern and control the grounds used
for said cemetery, subject to the approval of said council. They
shall have the right to lay off said grounds into lots and walks and
drives, and fix the prices of all lots offered for sale. Said commis-
sioners shall also have the right to assign such proportion of said
lots, and to locate the same, to white and colored people in proportion
as the population of each race bears to each other, and when thus as-
signed no lots shall be sold to colored people in the white district,
nor shall any lots be sold to white people in the colored district.
The proceeds of the sale of lots shall be used, one-half thereof for the
improvement of the grounds, and the other half thereof for the pay-
ment and retirement of the bonds issued under this act.
4. Be it further enacted, That the lands purchased or condemned
under this act shall be deeded to the commissioners or trustees to be
elected by the council of said town of Waynesboro, who:shall hold
the same in trust for the purpose named in this act, and shal! have
the power to make good and sufificient titles for all lots sold by them:
provided that no sales shall be made contrary to the provisions of
this act. Said commissioners shall make a full and complete state-
ment of their transactions at least once in every twelve months to
the council of said town, and shall pay over to the treasurer of said
town one-half of all the money received by them during the current
year. Said commissioners shall receive such compensation for their
services as may be fixed by the council of said town.
5. This act shall be in force from its passage.
