Chap. 115.—An ACT to grant the right of way for a public street through the
grounds of the Virginia penitentiary and to authorize the sale of a part
of said grounds.
Approved February 1, 1894.
Whereas it would be of advantage to the penitentiary to open
Spring street through the grounds of the institution to connect with
Arch at its intersection with First street, furnishing access to it by
an easy grade instead of the present highway through said grounds;
and whereas it is believed that, if the state will grant to the city of
Richmond the right of way for said street, the city will agree to
grade and complete it: therefore,
1. Be it enacted by the general assembly of Virginia, That the
superintendent of the Virginia penitentiary is hereby authorized to
contract with the city of Richmond or its authorized agents to con-
struct said street on such lines and grades as he may approve, and
upon the condition that said city shall grade and complete said street
ready for public use at its own cost and to the satisfaction of the
superintendent: and provided further, that this privilege be exer-
cised by the city within twelve months from this date; and upon
the execution of said contract and approval by the board of directors
and the governor, the said right of way 1s hereby granted.
2. The superintendent is further authorized, with the approval of
the board of directors, to sell such part of said grounds as lies south
of said Spring street extended, and the board of public works to exe-
cute deeds to the purchasers upon payment of the purchase money,
which shall be deposited in the treasury to the credit of the peni-
tentiary fund.
3. This act shall be in force from its passage.
