CHAP. 713.—An ACT to amend and re-enact sections 7 and 12o0f
an act entitled an act to establish a corporation court for the
a, of Radford, in Montgomery county, approved February 2,
Approved March 4, 1892.
1. Be it enacted by the general assembly of Virginia,
That sections seven and twelve of an act approved Feb-
ruary second, eighteen hundred and ninety-two, entitled
an act to establish a corporation court for the city of Rad-
ford, in Montgomery county, be amended and re-enacted
so as to read as follows:
§ 7. The circuit court of Montgomery county shall con-
tinue to have concurrent jurisdiction to hear and deter-
mine all cases at law and in chancery, except in such
cases as by the provisions of this act exclusive jurisdic-
tion is given to the said corporation court. All cases and
proceedings at law or in chancery now pending in said
circuit court shall be proceeded with in said circuit court
until the same are finally eoncluded or ended, unless the
same shall be removed to said corporation court by con-
sent of parties in interest, and it shall be lawful for the
sheriff of Montgomery county or the sergeant of the city
»f Radford, to execute all processes, notices or orders of
the circuit court of Montgomery county in the said city
of Radford.
§ 12. The said court shall have exclusive original juris-
diction over all matters of probate and record arising
within the limits of said corporation ; and all deeds, wills,
sontracts or other papers admitted to record in the clerk’s
»ffice of the county court of Montgomery county since
the city of Radford was chartered, and before the clerk’s
office of the hustings court of the city of Radford was
opened for the recordation of such papers, shall be deemed
and held to be as legal and valid asif they had been duly
Admitted to record in the clerk’s office of the hustings
court of the city of Radford, instead of being recorded
in the clerk’s office of the county court of Montgomery
county at the trial aforesaid.
2. This act shall be in force from its passage.
