Chap. 710.—An ACT to authorize the board of supervisors of
the county of Henrico to consent to the use of public highways
by the United States in constructing and maintaining a road-
way along the old Osborne turnpike.

1. Be it enacted by the general assembly of Virginia,
That the board of supervisors of Henrico county be, and
is hereby, empowered and authorized to consent to the
use of the old Osborne turnpike or road by the United
States in constructing and maintaining a roadway, not
exceeding one hundred feet in width, from the eastern
limits of the city of Richmond along the said Osborne
turnpike or road, to any point in the vicinity of what is
known as Fort Harrison.
2. That the said board of supervisors of Henrico county
are further empowered and authorized to acquire by pur-
chase or condemnation, a right of way not exceeding one
hundred feet in width, over any and all property that may
lie between the point on the said Osborne turnpike or
road (which shall be selected as the terminus on that
road for the said United States road) and the Fort Har-
rison cemetery, and also such property as may be neces-
sary to widen any highway mentioned or intended in this
act, to not exceeding one hundred feet, and to consent to
the use of any public highway or highways that it may
be necessary to cross or use in making a convenient ap-
proach to said cemetery; and if the said board of super-
visors cannot agree with those entitled to the land upon the
terms of purchase for said purpose, it shall apply to the
court of said county, which shall appoint five disinter-
ested freeholders (any three of whom may act) for the
purpose of ascertaining a just compensation for said land.
The appointment of said commissioners, the notice of
the application for their appointment, and the subsequent
proceedings shall conform to the provisions of the forty-
sixth chapter of the code of Virginia, eighteen hundred
and eighty-seven, as nearly as may be.
3. That when said right of way has been acquired, the
said board of supervisors are authorized to convey the
same to the United States free of charge, and to grant to
the United States the right to use the said Osborne turn-
pike as herein provided, and any other highway or high-
ways that it may be necessary to use in constructing said
road from the terminus on the Osborne turnpike across to
Fort Harrison national cemetery.
4. That to raise the money needed for the purpose of
this act the said board of supervisors is authorized to issue
a bond or bonds of the county of Henrico, and to make
provision for the payment of the same, said bond or bonds
shall be signed by the chairman of said board and attested
by the clerk thereof, who shall affix thereto the seal of
said board. |
5. That should the said board of supervisors fail to ac-
quire, by purchase or condemnation, the said right of
way or land to widen any of said highways to not exceed-
ing one hundred feet as herein provided, but consent to
the use of the public highways by the United States as
stated in this act, then the said United States is authorized
to acquire, by purchase or condemnation, the right of way
over any property that may be necessary to construct said
roadway under this act, and to widen any of said high-
ways to not exceeding one hundred feet, and in case the
United States fails to agree with those entitled to said
land as to terms of said purchase, then the said United
States is authorized to proceed by application to the court
of said county to have commissioners appointed to ascer-
tain a just compensation for the same in like manner
as is herein provided for on the part of said board of
supervisors; all of which proceedings shall conform, as
mearly as practicable, to chapter forty-six of the code of
Virginia of eighteen hundred and eighty-seven.
6. This act shall be in force from its passage.
