CHaP. 67.—An ACT to authorize and empower the Alleghany
iron company to construct and operate a railroad under certain
limitations. oo
Approved January 16, 1892.
1. Be it enacted by the general assembly of Virginia,
That the Alleghany iron company, a corporation duly in-
corporated by an order of the circuit court of Alleghany
county, on the eighth day of May, eighteen hundred and
ninety-one, and the charter whereof was recorded in the
office of the secretary of the commonwealth, on the twen-
ty-third day of May, eighteen hundred and ninety-one,
according to law, shall have in addition to the powers
now conferred upon it, the further power and franchise,
as follows:
§ 1. The said company is authorized and empowered to
construct and operate a tramway or railway with single
or double tracks, standard or narrow gauge; said tramway
or railway may be operated by horse or steam power, or
such other power as may be adopted by said company,
and may run to and from any of the properties owned or
leased by said company in the counties of Alleghany,
Botetourt and Craig, from and though any or all of said
counties; and said company may make connection with
any railroad traversing any of said counties; but any
such railroad shall not exceed fifty miles in length; and
in respect thereto, the said company shall have all the
rights and be subject to all the duties of a common car-
rier. The said company shall have the power to make all
necessary condemnations for its right of way and for ter-
minal facilities as are provided for, and in the manner
prescribed by the laws and statutes of this state: pro-
vided, however, that it shall not exercise such right of
condemnation as to any land held by it under a mining
lease or over which, under or by any contract of mining
lease, it has acquired the right of way for the term of said
lease. It shall be lawful forthe said corporation to ac-
quire by purchase any railway, railroad property, and
equipment and rolling-stock, or any other property from
any other corporation or person: provided, such railway
shall conform in its location, limits and extent to any
railway which said corporation might construct under pow-
ers of this act.
2. It shall be lawful for the said company to borrow
money, and to issue and sell its bonds from time to time,
and on such terms as its board of directors may deem ex-
pedient and proper in the prosecution of any of its work,
and to secure the payment of said bonds by mortgage or
deed of trust upon all or any portion of its said railway
or railroad property, as well as its other property.
3. This act shall be in force from its passage.
