CHAP. 542.—An ACT for the relief of C. W. Hardin. |

Whereas it appears from a statement in writing, sup-
ported by affidavit of James D. Anderson, late treasurer of
Rockbridge county, Virginia, that on the second day of
August, eighteen hundred and eighty-six, the said Ander-
son, acting in his capacity as treasurer, sold five acres of
land on Broad creek, in the said county of Rockbridge,
Virginia, for delinquent taxes to C. W. Hardin for eighty-
five dollars and fifty-five cents, of which amount thirty-
four dollars and thirty-one cents was due the common-
wealth; and whereas the said Hardin paid the sum of
money to said Anderson, treasurer; and whereas the said
Anderson, treasurer as aforesaid, has covered said money
into the treasury at Richmond, Virginia; and whereas it
further appears from the said statement that at the time
of such sale it had been improperly assessed in the name
of both Thomas L. Miller’s heirs, who held the legal title,
while at the same time it had been improperly placed upon
the land-books by the assessor in the name of H. R., G. M.
and D. E. Pearce, who had previously purchased the prop-
erty and paid all the taxes thereon, with J. G. Swartz
marked in possession, and overlooking this fact the said
treasurer had sold it as the property of the said Miller’s
heirs for their delinquency; and whereas the said C. W.
Hardin has paid thirty-four dollars and thirty-one cents,
which has been covered into the treasury of the common-
wealth without receiving any equivalent in return, and
being in no default on his part; therefore,
1. Be it enacted by the general assembly of Virginia,
That the auditor of public accounts be, and he is hereby,
authorized to issue his warrant in favor of C. W. Hardin,
of the county of Rockbridge, Virginia, for the sum of
thirty-four dollars and thirty-one cents. ,
2. This act shall be in force from its passage.
