CHAP. 452.—An ACT to amend and re-enact section 3717 of the
code of Virginia in relation to embezzlement of public funds by
public officers.

1. Be it enacted by the general assembly of Virginia,
That section thirty-seven hundred and seventeen of the
code of Virginia be amended and re-enacted so as to read
as follows:
§ 3717. Embezzlement by officers, and so forth, of pub-
lic funds; how punished; default in paying over funds
evidence of guilt.—If any officer, agent or employee of the
state, or of any city, town or county, or the deputy of any
such officer having custody of public funds, knowingly
misuse or misappropriate the same or knowingly dispose
thereof otherwise than in accordance with law, he shall
be confined in the penitentiary not less than one nor
more than ten years; and if any default of such officer,
agent, employee or deputy, in paying over said funds to
the proper authorities when required by law to do so, shal!
be deemed prima facie evidence of his guilt.
2. This act shall be in force from its passage.
